I, for one, feel so very secure and cared for in my life. I know in my heart that the government will take care of me, inform me, and look out for me...that I need make no decisions independently...that I really have to not even think...the government will do that for me!

I am tired of of government intervention in my private life.I say send them all home & start over.Smokers have rights too.

Just go ahead and make smoking illegal and quit trying to control what people do on/in their private property. Our cars are an extention of our homes, so are you going to ban smoking in homes where children are present? Like I said just make smoking illegal and get it over ith.

Senator Beffort and other Goody Two-Shoes Crusaders need to start keeping out of people's private lives.

I have kids and do not smoke in the car or the house, whether they are with me or not. I do this because I know that smoking and second hand smoke is bad and my kids do not need to suffer for the stupid decision I choose to make. But, I'll be damned if the government is going to come in and tell me that I cannot smoke! It is MY choice to smoke or not, with or without my kids

Yep, I see this case going all the way to the Supreme Court!

BTW, does that mean that the City buses, with all that carbon spewing out of their pipes, can get cited too? I might have my windows down and not know any better and breathe in these bad carbons? Can I sue the City for endangering my health?

The non-legislature in their uncompromising idiocracy have truly opened up a Pandora's Box.

I agree with William L, smoking is a grotesque behavior! Smoke stink to high heaven, it affects others, even worse children breath in that c ---p into their lungs. It’s a deadly pastime that should be outlaw completely. The only way to eliminate this problem is to shut down the tobacco industries.

The constitution doesn’t say anything about smoking! We all have rights but when rights go over board the constitution does not apply! If you want to smoke go the toilet and smoke that s---t there were it belongs!

When these clowns get rid of Polluting Cars, Air Planes, Buses, Trucks and Rail Road Engines, then I may (with emphasis on may) agree they might have the power to tell me when to smoke in my own property. Until then they can work on something more worth while.
Write some real laws, not bogus BS. People that have never smoked, or been around smokers die from Lung Cancer and other so called smoker diseases.

By the way research this one for me.
How much carcinogenic material is expelled by various vehicles compared to cigarette smoke?
If you devout non smokers drive any petroleum fuel propelled vehicle you're worse than a smoker.
I'm not knocking non smokers, and I don't smoke around folks that don't smoke. I'll go outside, but in my own car if I wish to smoke... You get the drift (no pun intended).

This country was founded as a Republic, not a democracy. In a democracy the rights of a few can be completely ignored by the majority. Somewhere along the way, our country has forgotten this. Regardless of what you think about smoking, I consider this a breach of many's rights. Not only that but in New Mexico, the vehicle is considered extended domain; which means that you can do anything inside your vehicle that you can inside your house... I think that these legislative types are forgetting this. I don't have children, and I no longer smoke - but it is encroaching on the rights of others (please look further than the "omg this smoke stinks and bothers me" and look at the actual breach of a person's civil liberties).
