The 21-year-old Morgan Hill man who died after he sped through a southeast Morgan Hill intersection and collided with a produce truck that spilled a load of peppers, has been identified as Martin Maese, II, of Morgan Hill.

Rory's death was sad as no parent wants to bury their child. Sadly, bikes and the City are also at very much at fault. Frequently, bike riders want equal space with autos while they ride two or three abreast, use sidewalks, and fail to stop at stop signs- what automobile could get away with that behaviour? Now look at the blind cross walk where this accident should not have taken place. Poorly designed, at a curve in a highly traffic road, shrubs and fencing blocking a driver's vision on a street with a 35 mph speed limit, no automatic lights flashing as routinely found in Palo Alto or how about Gilroy, all of these factors created the setting for disaster. Why did the City place a defective cross walk just some 100 yards from a well lighted and controlled intersection of Tennant and the Monterey Highway. Silly convenience and lack of foresight by the City created the probability of this fatal accident. Why was Rory riding a bike in a cross walk instead of walking it? The elderly driver now charged bears the brunt of those two failed situations. Morgan Hill officials have again brougth our City into a law suit no different than the ridiculous high school t-shirt incident - where a vice principal clearly violated the obvious free speech of his students, in favor of his own racial bias. Let's get rid of our elected heads and find some common sense folks, improve this City, fix that cross walk by eliminating it, and get Morgan Hill out of the courts.
