Listen, my friend. If you want to make that argument to the courts then get together with your friends and put up the money to litigate it. That's how the ACLU gets its money. From people who want the Bill of Rights enforced and are willing to donate to make that possible. If you think your argument is strong enough that it will convince the courts to overturn longstanding precedent and rule that religious symbols on public land are OK as long as private individuals pay for them and put them up, then good luck to you. You're going to need it.

I also observed that the ACLU's attack on creches coincided with the rise of the religious right as a political force seeking to legislate personal morality. I don't think that was mere coincidence. I think the ACLU overreacted by attacking harmless and legitimate religious expression right along with the truly serious threats to individual liberty posed by Christian fundamentalists.
