Jury query provides clues to Fierro defense

Full story: The Santa Fe New Mexican

Carlos Fierro will testify at his trial later this month and explain why he drove off after striking and killing a San Felipe Pueblo man who was crossing Guadalupe Street last November, his lawyer said Wednesday.

What did his (Fierro's) defense say, "even a sober could have had this accident". How tacky and low is that comment. Admit it, the guy was stinking drunk. He knew what he was doing when he was pounding the drinks as well as when he got into the drivers side. He hs no class what so ever!
New Mexico must be the laughing stock of the nation.

and so did Tenorio when he was pounding them and getting ready to drive the 50miles to san felipe...oh wait, that doesnt matter right. If youre mad at dui and drinking then lets not be a hypocrite and be angry with both.

how do we know what tenorio had in mind, thats just speculation, what we do know is that fierro was drunk, hit tenorio and left the scene of the accident, only fact is tenorio has no more future, his life was cut short, and all future generations of the tenorio family and friends will never spend time with tenorio, stay with the facts, the jury will decide on as Dragnet used to say "only the facts"

Cannot discern a rock from a human being? Possible if your BAC is nearly three times the legal limit.

I'm still mystified that Tenorio's blood wasn't analyzed for illegal substances. Ruben Lovato's blood was taken for analysis a couple of days ago. His BAC was only .03.

Fierro and his high dollar team are going to try like hell to "weasel" their way out of it. But "it was dark" "he was wearing a black shirt" and "he was drunk too!" arent going to cut it. Bottom line is that he was drunk, and driving. His negligence caused a death, and he right now is like a big fat rat with his tail caught in a wooden snap trap, figuring how to escape.

When someone fails field sobriety tests yet still tests very low in a breath alcohol test then a blood test is done to look for other reasons the person would be failing the field tests. When someone has an alcohol level above .08 then the law already presumes intoxication at a level which would cause impairment.

Taking blood tests on someone who is already legally drunk could allow a defense attorney to argue other reasons besides drinking for intoxication and allow defense attorneys to cloud the issue and create confusion in jury's minds.

Last week didnt the news show a case where a man killed a woman who was jaywalking in a dark street and didnt know until sometime after because of where on his car she was hit and it was ruled an accident? Seems to me that maybe that happened here. I think it says something he is going to testify that takes some guts and besides my friends and I have always said if we were ever in trouble and knew we were not guilty we wouldnt be afraid to take the stand. Just a thought.
Whats weird though is we as a society already think that there are games being played just to get him off but things happen, and I dont think a man would take the stand if it were gamesmanship

Its been reported repeatedly that those who were with him said he was the designated driver and was going to drive them home. And you're right, no more future and all of this is so sad and tragic but you know, you walk into the middle of the road not paying attention and backwards at that after drinking., heck, it can be expected.

isn't the RIO CHAMA on trial as well! They got off with a minor slap on the wrist while the STATE SID unit focused on the Blues Bar. Rumor has it that the former head of the SID unit Herman Silva has been rewarded with a newly created position in state government for turning a blind eye on the Gov's friends bar. A newly created position at a time of hiring freeze's? A State Police Lt. has been placed to over see SID and why not, State Police is slowly taking over the Department of Public Safety. A former stater in charge of the Police Academy, a stater in charge of the Narcotics Task Force, a stater in charge of the records section and a stater in charge of SID, Staters on Gov's boat and a stater in Fierro's car. Where is the oversight! I hope someone is paying attention?!

Essentially, Gorence said, could prospective jurors consider that "even a sober driver (might) have had this accident."

But a sober driver would have stopped to render aid!!!!

I agree with "Why" Where is the oversight to prevent these types of accidents from happening in the first place? Why isn't the RIO CHAMA on trial too? The Gov seems to be loyal to the almighty dollar, whoever contributes, are protected at the cost of the taxpayers' lives. Fierro, you drank, you drove, now you lose. As an attorney, you know the consequences of your actions.

When is the city ever going to fix those street lights anyway? Oh, and none of that matters because fierro was effing drunk. I don't care if all the street lights i town were out. He was driving without his own effing lights on AND he was drunk. Prosecute.

fierro and his attys' moral compasses are on display and its not unusual for this team of lowlifes but where's MADD at? They should be screaming bloody murder but are politically-silent...fat bill's corrupt ways go on! he will be the worst gov. in NM history! I hope the family sues the crap out of rio chama, too! NM needs your prayers that agagites like fat bill, gorence, bowles, NMSP, fierro & that strain of humanity are dealt with! HE is watching!

No, it doesn't matter, because Tenorio is dead! And Fierro got caught and Fierro left the scene of an accident. If it had been the other way around, THEN it would matter.

The street lights were working fine that night. Stop making excuses for Fierro. He was drunk, driving without his lights, hit a person that was legally walking across the street, and drove away! How much clearer do you need it?
