Thy can only sue if wht u r saying is lies but thy cant sue if it is the truth ..besides tht sd ppl wont sue thy need thier money for drugs..

You can sue! The current suit in duval is one the everetts, one of those girls has a facebook with all the topix forums that have ever been made slandering there name and hindering there future life. I viewed it all and its pretty interesting. I'm a mother and what hurt me was when I viewed the forum "I hate the big bird aka erica", on there a jenny quintanilla from san diego is typing, "i hate her, i want her 6feet under, i want to slap her, i want to play with her dead corpse," the forum is short but it goes on and on and by this specific person. Now that is very scarry, life theathening and sick. The facebook page will take you a couple of hours to skim through it all but pay attention to full details on how they were eligible for suit and how they did it. San Diego has become so ugly and aweful. Example; the very first forum they created on topix is incriminating Miss. Erica Everett, stating she killed a man. Click the forum, read every post, there will be 13 pages and lots of stupidty. Then view the next link of the accident report. It was declared an accident at the scence, stating, "No negliance". Don't make the mistake to read the police report first, read the topix forum first so you understand how mean people are and how low they went. You will then appreicate the vaule of the facebook page. Every forum will state the persons real information such as the name and location with a phone number followed by an address, and a little icon of a computer or cell phone meaning thats what the person used. Now I believe that every person who has been victimized by this website should do the same, I completley understand that no sufficient amount of money would ever gain your life back without someone referring to you as what was said of you in this website. But you will able to look back and see each and every topix poster in the same situational life style and thank them for your winnings. And it wouldnt be gold digging because you deserve it.

In law Slander is spoken word(s) and libel is written word(s) but they are both forms of defamation! Since libel is written, it is much easier to prove, and therefore file claim! The reason I was wondering was because there is plenty of lawsuits. You might be a familiar with the Lesher v. Doe case in Texas. In this case, the judge has ordered Topix to surrender the IP numbers of 178 users. This in turn opens them to civil and/or criminal legal action depending on the extent of the defamation... Now granted, this suite hasn't been settled yet, however, everyone is watching this case... and most feel, if won, that it will “open a whole new can of worms” so to speak. Lets face it, Cyber-slamming is going to create an entire area of legal issues for people who were, for example, denied potential employment because someone decided to publish slanderous/libelous information on them.
To address the "we all have freedom of speech??” comment, I say this, sure you have freedom of speech, but when you infringe on the life, liberty and pursuit of happiness of others it may cost you dearly. As the Topix phenomenon is spreading throughout communities everywhere and as the Internet Defamation Attorney's grow in number, it won't be long before someone puts a stop to this nonsense & if proven that you have caused detrimental harm to someones character and/or reputation through fabrications of stories, hearsay or lies without any tangible proof (ie. video, pictures, court rulings, etc).... Who's going to pay? Will it be you?? Are you willing to take the chance???

My name is celina cortez, benavides texas. If topix was a public forum where you can discuss anything with no restrictions then there wouldnt be a Terms of Service from the website owners. Remember this is their website not yours they have rules and by posting any message you are agreeing to them whether you like it or not. And rememer they can track you how else would they know how to tell you about your replies to your postings.
