Last week a backhoe was stolen from the Desert Shores ponds. When the crew showed up to start their work they looked around and said "Where's our Backhoe"? Dumb I know but fits this story.
With all the building going on and all the stealing that has risen, you'd think that this scenario would have been thought about. It could have been stored at station #2, as they used to do before. Leting it sit at an unpartoled area is just tempting for something to happen. Stupid id as stupid does.
A lock is just to keep an honest person honest!
Why was this kept under wraps? Could have put up posters!

Do you think they'll give me an award when I finally get the County of Imperial to turn over the $350,000 worth of Fire Impact Fees that they siphoned from the SCSD and that NONE of the other Directors have the BALLS to demand it from the County?

Probably not.

Mr. Barret, I have a question. I do not know how easy this FIRE IMPACT FEE was to find? My question is, Shouldn't the AUDITOR for the District have found this and pointed it out or the Management Team?
Brings up many other questions if the Auditor should have done this. I will await your reply before I ask more depending on your answer.

I found out about the improper Fire Department/Street Lighting Impact Fee when I was researching sponsoring an Ordinance that would collect a modest developer impact fee for parks and recreation, "for the children".

As I learned more about the Mitigation Fee Act it became clear to me that the previous Board, which included current members Butler, Palmer, and Urbanoski, and current candidate Kent, did not have the authority to impose an impact fee at all. The Mitigation Fee Act tells you HOW to impose an impact fee only. It does not give you the authority to impose one; that authority comes with "land use authority" which only countys and citys have.

When I found this out I suggested to the General Manager that we get a legal opinion on it. After pulling teeth the laywers were finally asked the question and they answered with a resounding NO. The SCSD was not authorized by law to collect ANY impact fees.

Now up to this point I was keeping the subject low-key until the Board could agree on a stragedy to refund almost a half millions dollars of improperly collected fees. Then the board as a whole would "go public" and announce its' mistake and announce their refund plan.

Then, when I found out that Director Butler and GM Tom Cannell were spending thousands of taxpayers dollars on lawyers to try to find a way to "rename" or "re-classify" the illegal fees that were already collected so that the district could keep the ill-gotten gains, I was forced to go public and mobilize the masses with much help from my wife, and current board candidate Torri Barrett ( www.torribarrett.com ), to inform the public of the money that they were owed.

Torri and I used the power of the press as well as pressing flesh to rally the troops (yes, you the public) to inundate the district office with volumns of requests for refunds.

It took me fighting this Board for 5 months before the refunds started being handed out.

Now to answer your question....I went on line and searched the term "Developer Impact Fees" on google and read, read, read. It was not that hard at all and there were many simple layman articles on the subject. Why the past board did'nt try to educated themselves individually or at least ask the lawyers if and how to impose Impact Fees I'll never know. Well actually I do know....I...N...C...O...M...P. ..E...T...A...N...C..E.

Up to about half of the money collected has been refunded. The interest that has accumulated on these fees is being spent unabashedly by the district. They don't even have it in a seperate account as required by law for "unclaimed property"....they have NO SHAME.

Now to answer the question about why didn't the auditor catch this.

Well the annual audit is contracted out for the purpose of seeing that the district is using a State prescribed accounting system. By his own admission the auditor is just verifying if the district is following proper accounting procedures, not whether or not the district is using or collecting monies properly.

Unfortunitely the "working papers" of the auditor are not public records, only the finished product is.

I can tell you this though; I bet the auditor bathes thoroughly when he gets home from the district.

Why your passing out awards, can you get Director Barrett a BS (BullSh*t) license from diplomias-R-Us they have a deal today, they toss in a legal degree for an extra dollar.

Mr. Barret, Thank you for opening our EYES AND EARS. Where was this Impact Fee headed? Into ones pockets, Private Pet Projects? I guess we won't know now.
So, now if you see a Board Member at the Main Office constantly, one can only assume that another Scheme is in the works? I know that Directors are not to interfere with day to day operations of the District Policies that are set in place. This must mean that Regulations have been broken and kept the General and (HA) Assistant Managers from completing their daily duties to work on this scheme?
By the way, and I know this will bring attention. The Assistant Managers Position was only in place for ONE YEAR. Isn't this time expired? Do we really need an Assistant Manager? How does one get FOUR POSITIONS at the same time? Only at SCSD! Over Paid and Under Worked!

There was an "employee evaluation" closed session scheduled a few months back for the Ass. Manager Position but it was cancelled the day before (and three days after the agenda was publicly posted) when the district found out that I was leaving my job early to attend.

The meeting was never actually intended to be an "employee evaluation", it was an attempt by President Butler to have a closed session without me so that they (the GM, Ass. Manager, and Directors Butler, Palmer, and Rouhe) could further plot and scheme on how to shut down a privately owned website ( www.saltonseawest.com ) and exhort copyrighted material from it. So far the District has spent over $12,000 in lawyers fees in a failed attempt at censorship of public criticism of their behavior. And let’s not forget the cost of labor it required to remove the “public forum” bulletin board that use to be outside the district office after they received the second cease and desist letter from Salton Sea West demanding that management and certain board members (two of whom are up for re-election) refrain from removing it’s flyers from the bulletin board.

This was the second time they tried to keep me out of a closed session.

The first time they tried they couldn’t quote any legal statute that would allow them to keep me out.

The third time they spent $2,000 on six lawyers to draft a bluff letter to me explaining why I couldn’t attend a closed session. When I called their bluff, President Butler had Ass. Manager Rosa Reagles call the Sheriffs Department.

Under threat of force by the responding Deputy I was prevented from fulfilling my duties as a Director. It’s for times like these that I digitally record all public meetings that I attend…..for the documented evidence.

A short time later I sent a VERY POLITE letter to the County Sheriff as well as the County Board of Supervisors and the County Counselor explaining that I would not tolerate a second instance of the deprivation of my rights to attend district closed sessions. My intention to not cause the Deputy any grief was also stated in the letter.

With all due respect Mr. Deputy, you see lawyers in action almost ever day down at the courthouse, you know how they manipulate and distort the statutes to their own ends, whether or not the results are a true depiction of reality. I wish you luck at your new job.

Now to finish answering your question Eyes and Ears; It is my understanding that the Ass. Managers Position is reviewable and renewable annually. But what good is an annual job review if 3 or more of the Directors, the GM, and the Ass. Manager are in bed together?
