What could be the justification for not paying your taxes?
If I don't pay my taxes they sell my property or put leins on it or worse you could go to jail. So what makes SIU Special?

Question is do we have people in the City Government that are smart enough to match wits with their lawyers. Is the Council and their Lawyers smarter than a Fifth Grader?
Or even a First Grader?

Salem's esteemed council members are going to receive a law suit notification soon if they do.

I think more than Israel should be led out of the
council with handcuffs on. Make a great story for TV.

SIU may trade intellectual capital for unpaid B&O
taxes. Do they have it to spare?

I think it is totally unfair they do not pay their BnO and you have one council member trying to enforce the ordinance and no matter how much negotation that Janitor Jim Professor Dave or the new patsy does they still have to enforce the ordinance as written. If they choose to exempt SIU or cut them a break every business in Salem should demand the same kind of treatment. Unfair and unethical.

FYI, The CFO up there pulls in more than $400,000
per year. Don't ya think SIU could do their civic duty and pay the damn taxes like the rest of us.
Instead of always trying to poor boy the city.

SIU does not necessarily have to pay B&O taxes in Salem because they are not completely "based" out of Salem, WV. They have administrative/online college ofices in Carmel, Indiana. They pay their share there and thus the income is not made in Salem. This is nothing new!

anything that is ran through salem "on campus students and online students as well" is BnO I love the exponent , they may let Salem use a grant writer , When did SIU get a grant writer, they may finance a police officer, when did SIU become fans of the PD. The best way is BnO it would be a constant steady supply of funding for the city. If you think they are really going to move the college after investing millions on campus you all would be wrong, I WOULD SAy it is a safe bet that the big dogs will threaten that but that will be as far as it goes, but when you look at who the city has looking out for our interests you know we are screwed.

If they are allowed to barter their taxes then the Florist should be allowed to send flowers to the CFO,and the BP should be allowed to contribute a tankful of gas,or the IGA can barter a loaf of bread,or how about the Barber shop gives council a free haircut. What an obscene idea, Grant writer.

Salem resident 2, to answer your question. Even though they have administrative offices in Indiana makes no difference. The business initiates in Salem therefore it creates "nexus" A few years back a bank tried to use the same logic that they should not have to pay B&O taxes to the City of Charleston, however, the WV State Supreme Court ruled that it did create nexus and therefore they were still liable for the tax. If they are a private institution of learning and are making money as such, therefore, they would not be exempt from the tax because they are not a public entity. Therefore, according toe state code, they would be responsible for paying the tax. I would love to read the city's B&O Ordinance. I do hope the city does not back down from this fight.

Just a question, contact councilman Williams he was in my shop recently with a packet of information including the city's ordinance on BnO taxes, and the legal opinion of Fran Whiteman, it said the city should be collecting BnO off the university, but then you read the news the city is backing off by willing to "Barter" for a grant writer or let the university finance a police officer. I love Max anwser let all the shop owners barter so we can save our money and just use our stock in our shop what a bunch of morons at the city building.
