BALDWIN PARK - Two Baldwin Park Police officers are accusing the city and three officials of passing them over for promotions because of their history of outspoken criticism of city leadership.
Baldwin Park Police Association (BPPA) President Mark Adams and Vice President Chris Kuberry filed a lawsuit in federal court on Jan. 19 against Police Chief Lili Hadsell, City Manager Vijay Singhal and Councilwoman Marlen Garcia.
"At this point, it has become crystal clear that Adams and Kuberry have been, and will continue to be, passed over promotion, notwithstanding their proven qualifications, because of their speech and activities as BPPA President and Vice-President," according to the complaint, filed in the United States Central District Court.
The men allege that their constitutional rights to freedom of speech were violated when Baldwin Park officials failed to promote them in retaliation for their criticism of city decisions, including the firing of former Police Chief Edward Lopez in 2008.
Baldwin Park City Attorney Joseph Pannone said the lawsuit has no merit.
"I can tell you that the city feels the lawsuit is not a valid lawsuit and we'll be defending against it vigorously," Pannone said.
Hadsell, Garcia and Singhal said they could not comment on the case since it is ongoing litigation.
According to the lawsuit, the Police Department ranks employees eligible for promotion based on their performance on
tests the city administers.
Based on those rankings, Adams and Kuberry were appointed acting sergeants, but were passed over for a permanent position when there was a vacancy, although they were ranked as the most qualified - with Adams ranked No. 1 followed by Kuberry, according to the complaint.
Leticia Lara, the city's human resources manager, said the city does not rank employees based on their performance on tests administered, which vary according to the department and position. Instead, each hiring department is provided with an alphabetical list of eligible applicants, she said.
"(The lists) are the names of qualified applicants and the hiring authority can pull from that list as they determine the best fit for that department," Lara said, although she wouldn't comment on this specific case.
Both Kuberry and Adams have been vocal opponents to cuts to Police Department resources and have openly criticized Singhal for cutting positions in 2007, according to the lawsuit. They also distributed fliers to the public about staffing cuts.
The men also publicly conveyed the BPPA's disapproval of Councilwoman Marlen Garcia about a decision that led to the dismissal of former Chief Lopez, according to court documents.
"It was brought to my attention that this council fired Chief Lopez," Kuberry is quoted in an article in this newspaper in 2008. "I am disgusted with your actions to say the least."
The comment was made during a City Council meeting.
Kuberry and Adams allege that Hadsell, Garcia and Singhal have all made statements indicating their "opposition" and "displeasure" of their open criticism and actions.
Kuberry and Adams' complaint requests that the city place them in their appropriate positions without discrimination and pay any attorney fees and costs of the lawsuit. In addition, it calls for unspecified damages according to proof in the case.
Further, Adams and Kuberry are requesting a jury trial.

Well well I wonder how this is going to turn out the city's three stooges and let's not forget the city attorney working hard to defend themselves from discrimination.
Well I know they will have the facts from me on how the inner workings of a revengeful Garcia and two butt kissing city leaders the city manager and hadsell operate.
The anti white movement in the city to remove all white officers which is told in many interviews and council recordings. I can tell you this if the city attorney or Benejerks firm handles the case it is a slam dunk to win. The city attorney has lost numerous cases for the city including the one for failure to produce public documents. That only cost them a little over 200,000.00 but the council didn't care it's not their money.
Marlen I guess you can go and talk to Breceda now on how it will feels in court and god for bid you have to testify and your hateful self gets brought out. This is funny you might have to put on makeup and actually have to smile with that ugly mug. Hey don't worry vejay they have booster seats on the witness chairs so you can see everybody and Hadsell just stay on the meds and do whatever your told to say but remember perjury is a very real crime and you don't have many friends in the department now since you stabbed your boys in the back door political reasons.
I can hear it now BP leaders confess and run out of town one to Mexico one to Peru and the other to India what a great newspaper headline.

We know that this is out of the city attorneys league hell he can't even defend against failure to produce public requests.
Then we know that federal court is out of Benewacks league he couldn't even win a simple lawsuit for daddy against Rubio's sister.
Wow I guess we will wait and see because since they did this crime with the intent to commit a personal attack on these officers we feel they should be paying for their own attorneys.

A cadet who said she was sexually harassed and later forced to quit has sued the Irwindale Police Department, the second lawsuit in six months to question the behavior of a high-ranking police lieutenant
Both lawsuits filed against the agency name Lt. Mario Camacho. In July, Officer Rudy Campos filed a federal lawsuit alleging that he didn't get overtime and received negative performance evaluations after he voted against a contract provision Camacho favored. That case is pending.
The most recent complaint, filed Dec. 11 in Los Angeles County Superior Court, alleges that Camacho sexually harassed Alma Chavez, a non-sworn police cadet who started working with the department in 2008. She alleged that Camacho held her hand, kissed her and groped her while they were on duty, sometimes in his office or city-owned car.
Initially, she rebuffed his advances, but gave in when he created "a hostile work environment," according to the lawsuit. When Chavez accepted Camacho's advances, he promised her a full-time permanent position with the city.
Camacho "would be really mean to her and make it difficult for her at work, but when she accepted the advances he was really nice to her," said Brandi Harper, a lawyer representing Chavez and Campos. "When she started, she was 19 years old, her dream was to be a police officer and he knew it."
Irwindale Police Chief Dennis Smith referred questions to attorney Jeffrey Thompson, who is representing the department in both lawsuits. He declined to comment on any specifics.
"The city takes these type of matters very seriously and believes it has done nothing wrong in this case," Thompson said. "We will be defending it aggressively."
During Chavez's more than four years of employment at the Irwindale Police Department, Camacho gave her gift cards worth hundreds of dollars at Victoria's Secret and Forever 21, as well as a Tiffany's bracelet and Louis Vuitton purse, according to court records..
In an October deposition, Camacho didn't deny that he gave her gifts and admitted kissing and holding Chavez's hand while they were on duty because they "were close friends."
He said he also lent her money and rented Chavez a condo he owned at below-market value to help her out, but later asked her to move out when he discovered someone else was staying there and not paying rent.
In the lawsuit, Chavez said that she felt forced to quit and that Camacho was upset because she was living at the condo with her boyfriend. He allegedly called her into a meeting and told her, "I can't stand working with you anymore, this meeting will be your two weeks' notice."
She submitted a resignation letter after that meeting, according to the complaint.
Thompson declined to say whether Camacho had been disciplined or placed on administrative leave.
