As we near primary day, Janetta Hicks has been increasing the number of campaign flyers she has been mailing out. Her most recent attacks her opponent, Janet Ellis, for not "representing our values." The point Janetta is trying to get intelligent people to believe is that since Ellis will not publicly denounce gay marriage, she couldn't possibly be an effective district attorney.
I believe Hicks' strategy of making gay marriage a talking point in a race for an office where it has no bearing is her way of avoiding running the campaign on her record.
Here is her record:
The fifth judicial district which encompasses Eddy, Lea and Chaves counties, had 60 employees. In three years, 53 of those have been forced to leave or quit because the working conditions were so intolerable. In replacing some of the attorneys who left, Hicks hired a convicted drunk driver who also was facing charges of violating a domestic peace order. Her newest hire for the Carlsbad office is rumored to have filed a false report of rape against two Eddy County Sheriff Deputies. In a recent candidates forum, Hicks told the audience her offices were fully staffed. A week later she hired a new attorney. Guess she wasn't fully staffed after all.
In the 5th, police officers act as prosecutors on most misdemeanor cases. Hicks will tell you they are just prosecuting small offenses such as littering or traffic offenses, but in truth, they are being asked to prosecute battery cases, shoplifting cases, some domestic violence cases, drunk driving cases and many others that take a lot of preparation to prosecute. I know this is the norm in other districts and it works well there, but the 5th does not have the resources in law enforcement or the DA's office to make this an effective practice. As a result, police officers are either pulled off their duties protecting the public or deals and dismissals are offered to the defendants.
There has been a 33% rise in criminal cases in the 5th in the past three years. Hicks will admit to this herself. Why is this, maybe because she is taking police officers off the streets to act as attorneys so criminals feel more at ease to do their work.
She spent so much operating budget monies on cars, phones and other things that her employees had to take additional forced furlough days. The state in the last few years has already instituted its own furlough days. The DA's office had to take others in addition to the state imposed days.
She hired an illegal immigrant (although she opposes driver's licenses for illegal) to work in the DA's office with confidential files. That man, Alberto Aguilar, is now serving a 10 year prison sentence for raping a teenaged boy in a motel.
There is a murder case in Lea County going unprosecuted because the murder victim was gay. A couple in Roswell lost a son in a shooting and, even though it is known who committed the crime, it is also not being prosecuted because to do so would be "a lot of work."
A man in Hobbs who pointed a gun at his kids pleaded out and is out of jail.
Her office, even though she will say she doesn't deal with drug dealers, tried to get a Roswell judge to sentence a convicted heroin dealer to 60 days in jail. Trafficking is a second-degree felony with a max sentence of 9 years.
This is just the tip of the iceberg with Janetta Hicks' record.
To all republicans in the 5th who read this, don't be fooled by smoke and mirrors. Hicks thinks we all are stupid enough to not look at her record. We are not.
Vote for Janet Ellis for District Attorney on Tuesday, June 5.
