This is what prosecutors do. They charge everything possible. If it involves a school bus, for example, that could be 50 counts of attempted something. Defense attorneys are very creative as well. They construct theories that can knock a charge down on technicalities. So it becomes a chess match with each side putting as many players on the board as possible, knowing they can all be swept away with one arm swipe if a deal can be made.
We have seen potential bombers go away for life sentences even though they were stopped before any injuries took place. This case is similar. Lester fired his gun at everything on the block. He hit two police vehicles and the officers were lucky enough not to be injured. So bake his final list of crimes down to a few counts and go with the life sentence. They need those few and not just one in case something comes up.
