I have joint physical custody of my 12 year old. I get payed child support by my ex and my child spends as much time as he wants there. My child recently said he wants to live at his dads house instead of mine. Of course I'm heartbroken but does anyone know what will happen with the child support? Does he have to take me court to get physical custody? any answers appreciated thanks..

Yes, at 12 he needs to take you for custody and he needs to file a modification for his support to be dropped. 2 different petitions and 2 different judges.

WOW...seems you care more about the little bit of child support more than you do your kids wanting to live with his dad instead of you....you must really suck as a mother.

What do you think happens to the child support? If you had joint custody you shouldn't have gotten any anyway. That is my opinion and I am also a single mother who gets support. The only difference is my child NEVER goes to his father's. Naturally the court is not going to make him give you child support if he is not living there. In fact they should make you pay. Also your public assistance will be cut,I am sure by this stupid post that you don't work. To bad,no more drug money.

Yes, the father will probably file a petition for support and you will pay him.

Thank you to the first poster for responding. Yes I am heartbroken he wants to live with his dad but he is at the age now where this happens and I'm not going to tell him he can't or make him choose sides. My question about the support is because if I don't recieve it anymore I will have to sell the home my son was brought up in and no the support hardly covers the mortgage! I work two jobs to pay for everything and its still not enough! My ex has more money than he knows what to do with!!

should've moved out of the house when you divorced and found something more manageable. Child Support is not a salary bonus. Here's a little known fact, if your child is old enough (around 16 here in NY) your hubbie can have the support directly paid to the childs account. I've done it.

Most men make more than women. If he's like my ex, he'll file for Vindictive Support.

Can't blame him for not paying support if the kid isn't there. You're gonna have to get a small apartment.

The mortgage has gone up hundreds of dollars because of the rise in taxes in the last few years.Like I stated I have physical custody of my child and wanted him to reside in the same house he has always lived in.He gives me a very small amount for child support considering he owns a large business and makes a lot of money! Yes he is Vindictive and now that he has a big beautiful home he has brainwashed my child to live with him!
