I have an order or protection against someone in rome family court. How long after submitting the paperwork do you think I can see a judge and get it dropped based on your experience?

Never. Judges dont like to go back on those. They feel if they are requested or given its done so for a reason. God for bid something does happen to you after they reverse their original decision than it would fall back on them. Think about what you do before you do it next time. Oh and speaking from experience dont break it either. Thats a good two years in prison for both parties if you get caught. Contempt of court.

Maybe your dumb ass shouldn't have filed an order of protection in the first place.

You can't just take that shi.t back. Clearly there was a reason for it. The person will do you wrong again after you get it dropped. You are better off keeping it.

How silly of me to assume topix was a public forum where I could solicit helpful information from others in the community! I can't believe how quickly people assume they know your circumstances and based on a couple sentences ive wrote believe you have enough information to deem me a "dumb ass" I know what contempt of court is and that it is punishable. I also had no intention of breaking that order which is why I came on here to ask, from experience, how long does it usually take for the modification to go through so I can see a judge and explain to that judge why the order or protection is no longer necessary. Thanks for your kind, helpful info guys, and hey! Stay classy Romans!

You tell people that you went through the court system, which is run using our tax dollars, to get an order of protection that hasn't even been filed yet, that you want reversed right? What part of that scenario doesn't ring a bell with you that it might be a tad absurd? If it was needed so recently the paperwork is still being put through, there is no way that someone can change so rapidly that it is not needed anymore. The only thing that changed is your attitude towards the person you filed against.

So all people can really take from this is that you either filed a protection order against someone who really wasn't a danger to you, or you are another one of those victims of domestic violence that keeps taking their abuser back. Either way people are sick of people like you abusing the court system for their loverd spats. Don't expect sympathy here when the situation you actively participated in leaves no room for it.

And another one! You can complain about me using your tax dollars if it makes you feel better but guess what? I am employed full time in this city and pay taxes and I recieve no benefits so I will use OUR tax dollars as I see fit. The original order has already been filed. The modification has not. Perhaps your reading comprehension is poor? As for my reasoning, it is really none of your business. Circumstances have changed. I am not "getting back" with this person. Also he is not physically CAPABLE of hurting or even coming near me at this point. However, I thank you for your input, its really appreciated!

just another woman who felt wronged in some way and wanted to get revenge by filing false accusations. Women like this should be shot in the head so they're no longer a threat to anyone else. let's assume that you're not a lying bitch and the OOP is legitimate. There'd be no reason to retract it. If there are kids involved Family court can stipulate visitation. If you haven't gone to court yet and you've only just filled out the paperwork, don't show up to court and theyll dismiss it. Family Court gets lying Bitches in there every day.

Once an order is signed and given by a judge it is put into effect immediately. The judge will not modify that order once its put into place either. Not showing up to court will not make them "forget" about it either.

I did not get the order for an unjust reason, my reasons were legitimate and not because I wanted "revenge". However I will say again, none of you know the circumstances and they have changed since the order was filed, he is NOT PHYSICALLY CAPABLE of causing harm to me or my family anymore. Also, you can get an order dropped for various legitimate reasons, one of which I have, he is NOT PHYSICALLY CAPABLE of harming me at this point and I need to be able to contact him. There is a modification petition for these reasons. Is there are any unbiased, sensible romans left that can just answer the question, that would be lovely. So back to the original question, after filling out a modification to an order of protection petition, what is the typical time frame before you will get a court date to speak with the judge and get the order dropped if they decide its appropriate?(Which they will because I have a legitimate and rational reason for doing so)

They will modify the order being he is locked up and you have a child in common, in which no one else will have a part in bringing the child to see his or her father. If this is the case then they will drop it too a refrain from order or if you want it completely dropped it's anywhere from 3 weeks to 6 weeks before a court date. I highly suggest you reduce it to a refrain from order because it would be very hard for you to get one if it's needed again. Just saying

Well you wont get a "sensible" answer. Or the one you're looking to hear without you providing details then. Weither your asking us dumb romans or those smart new hartford people with what your providing you will get the same response. And any smart person would ask the courts themselves rather than relying on topix to have the right answer.

I agree with fact. Even tho he's not physically capable of harming you, when he is if there is no order then you will be in danger. They will modify it so that there can be verbal contact and so on and so forth. But do not violate that order in place now. You could get into big trouble. Wait until it is modified. And again for you safety I wouldn't get it completely dropped. Not that a restraining order has ever stopped anyone in the past anyways, but it will help you if such a problem arises. I did ask the court. They said, "You will get it in the mail." And there is no "right" answer, the answer can vary, which is why I asked from others experience, how long is the typical waiting period. Thanks stupified :]
