My boyfriend and I have a court stay away order of protection on him but we have been seeing each other and texting emailing and having sex all we are not suppose to do if we get caught will we both get in trouble even if i am the one who got the order on him and that judge was mad at him and firm for him to stay away...and how long will he get in jail?and me?

You do realize that if you have an order of protection in place and claim to be the "victim" and you are still having sex and contacting each other this is a violation. And you will be held responsible as well. Not to mention you look like a complete irrational crazy person. This is rediculous.

hello sean yes she's loony all battered women are the men make them feel like they need to be controlled and women are stupid cause they can live without the abuse but still both parties will go to jail I hope she kept all dates and times and emails and msg.

My sister had a problem with a guy who talked with his fist unfortunately she kept on going back.Men like that are smooth talkers they know just what to say gladly my sister and him never got caught,but I do think that both of you will be punished,he will get a longer sentence though and you girls need to know no man has the right to put there hands on you no matter what.A good guy would never do that and there are alot still out there.Good luck

Legally speaking, if you have an order of protection against someone, and you voluntarily and mutually allow one other to come into contact, the order becomes null and void. Just the same as if you have a custody or child support order, and then move back in with the other parent, it becomes null and void.

However, if the judge/police are feeling froggy, they can arrest him for Criminal Contempt for violating the order, and then arrest you for Criminal Solicitation for assisting him in violating the law.

Go to court and get the order dropped the legal way. Save yourself a lot of hassle in the long run.

went to the judge to drop it him and the DA said a firm NO cause my boyfriend has a history of violence so they would'nt drop it....and then they looked at him and said if you don't stay away from her you will violate the court order and the judge was'nt playing

If there's an order if protection it was ordered for a reason. You may get along now but leopards don't change their spots. Whatever happened before will inevitably happen again. When it does, I'd say you both will pay for it.

The truth is an order is issued by a judge and only the judge can make an order void. The requesting or protected party can not consent to contact. Therefore the person the order ia against is still in violation. The person who is protected will never get in trouble for having the other person around. This is done to keep them protected and not be fearful to ever contact police. Even when they may have consented to the contact. Read the penal law. There is no such charge.

You are incorrect. The protected person CAN be charged if they knowingly and willingly allowing and assisting the person to violate the court order by not enforcing it.

S 100.00 Criminal solicitation in the fifth degree.
A person is guilty of criminal solicitation in the fifth degree when, with intent that another person engage in conduct constituting a crime, he solicits, requests, commands, importunes or otherwise attempts to cause such other person to engage in such conduct.
Criminal solicitation in the fifth degree is a violation.

If the contempt charge that the violator would face is a felony, they could be charged with Criminal Solicitation 4th which is a misdemeanor.

It is an OPTION for the protected person to be charged, but I don't think it's often enforced. The only cases where I've seen it enforced is where the protected party is constantly getting orders, and then allowing the other party to violate them.

That's not completely true. Many times these orders are written to expire after a year. It depends on the severity, whether or not it resulted from a crime, attorney's request, and the judges call. Most of them do expire, though.
