heard a rumor that someone has filed a lawsuit in new york state naming a number of city hall employees for 15 million. Does anyone know of this?

When officials or city employees get sued the payment does not come out of the paycheck or checkbook of the individual, but instead gets passed on to the taxpayer. Hopefully this gets settled for significantly less than $15M because another significant tax hike is not needed in these tough economic times.

Obama is the only one not listed in the lawsuit. Russitano vs Brown, Fusco, Dominoco and others. Filed Nov.2,2012 as 6:2012cv01641. Pretty long read. I'm sure this is just one of many to follow. People tend not to chat about lawsuits they intend to file, until it's done. I'm waiting for an even bigger suit to rear it's ugly head.

Does this mean that other people who were insulted, lied about, and had their charter assassinated by Russitano are going to be able to sue him now? What Fusco needs to worry about is getting charged with conspiracy by entering into some type of an agreement with Garrett especially if it involved the election. This ought to be interesting.

A $15.5 million civil rights violation lawsuit has been filed against the city, the previous administration and the current one by Garrett Russitano in U.S. District Court.
Russitano, representing himself, filed the suit in the Utica office of the Northern District, with Judge Lawrence E. Kahn presiding. It names the City of Rome, Oneida County, New York State, former Mayor James F. Brown, current Mayor Joseph R. Fusco Jr., Common Council President John J. Mazzaferro, Code Enforcement chief Mark Domenico, former Public Safety Commissioner James F. Masucci and John and Jane Doe.
"All through this clear case of selective enforcement and campaign of destroying me and my business the Oneida (County) District Attorney Scott McNamara and Rome City (Court) Judges Daniel Wilson and John Gannon, part of the New York Unified Court System never lifted a finger to stop this illegal activity." McNamara, he claims, responded to his complaint by saying: "You’re not the only one Brown’s doing this to," while the judges ignored his complaints. He states that patrolman Sanders — likely a reference to Jeffrey Sanders, the city’s lone police officer with that last name — failed to protect his property by "not arresting a man that he caught cutting my gate lock and then threatening to arrest me if I cut his lock to gain access to my property."
Fusco, Masucci and McNamara, he claims, interfered "with my right to free speech by not taking action against the person who threatened me on the ‘Topix’ website and refusing to supply me with information or identifying the person and denying my (Freedom of Information Law) request causing me to remove my web site exposing the City Hall, but they charged me with threatening someone and arresting me, even though I didn’t threaten anyone."
When on Nov. 23, 2009, the fire department posted his building at 109 Canal St. and barred him from working there, he claims, Brown let his two tenants work without interruption. "It was business as usual for Rofin LLC and Elagrace Caskets," he stated. The city, he claims, removed equipment and stock from a fenced storage lot at 701 Lawrence St. without proper eviction in July 2009.
He also claims that he was charged with five code violations on Aug. 11, 2009, then the city violated his right to a speedy trial "simply to harass me and using the Rome City Court to carry out the mayor’s vendetta against me."
Masucci and Brown "conspired to have me arrested for an email that was sent from my home in the Town of Floyd and then ‘railroaded’ me in Rome City Court when it was not in the city jurisdiction."
On Nov. 4, Rome police arrested him at 5 p.m. on a Friday "with the intent to make me spend the weekend in jail without chance for bail, on an alleged codes violation, he claims.
Fusco, he said, failed to deliver on promises he made in exchange for campaign support. Therefore, Russitano claims, Fusco "breached a contract" made on Dec. 4, 2009, "in return for my help and support in his campaign to run for mayor of Rome, even though I carried out my agreement to the fullest." It does not disclose any details of the agreement.
The complaint lists numerous other incidents similar to those already outlined above, as well as related to other topics. The incidents listed number over 100 in about 10 years.
In addition to the monetary judgment of $15.5 million, and $5 million each from Brown, Masucci, Mazzaferro, Domenico and Fusco, Russitano is asking for the return of properties taken by the city at 1333 E. Dominick St. and 701 Lawrence St.

Garrett has turned against him. Guess he forgot to mention in the suite the Republican chair, DPW, RFD, RDP for Joe not keeping promises to them to.
