Just read the KY3 article. Surely cant believe everything you read. Happen to know that Delbert
Smith is facing alot of prison time and made the comment he was not going back. Guess he figured making up a story would save his own sorry hide. He is a known thief, liar and junkie and has never taken care of his kids a day in their lives.
There was no evidence 20 years ago that Farrell was in anyway involved and there is none now. Just an attempt by someone who is too lazy to work and to stupid to steal to save himself from going to prison. Shame on you Delbert!

Delbert isn't the only witness they have ...
The Feds wouldn't bring charges if they didn't have some evidence.

You are right there are other witnesses. Robert Sharp is in prison for rape and the others are drunks at a bar 20 years ago. I'm just sayin....

I agree with you that most of them aren't upstanding citizens.

Seriously? I was there that night and it went down just the way the story says-and before everyone jumps down my throat-I was drinking a coke and talking to my friends-which, by the way is what alot of people do in a bar.

If the feds are taking the case don't they have to have enough evidence to pursue it? I am sure that they have taken into account the credibility of all of the witnesses. Maybe they have some other kind of evidence also that they are not letting out. I was under the impression that if a case is under investigation they are very hush hush with the evidence??????????

And as far as the drunks at the bar, I have been to bars before and I sure don't consider myself a drunk. They were all the people that were there at the time of the event. Even if they are questionable charachters if they are all telling the same story I would think that would have to carry some clout.

Of course they wont tell what all of the evidence is!
All of the witness statements were taken years ago, They have probably interviewed them all again and added any new information.
I doubt they are prosecuting on witness testimony only, They couldn't do it 19 years ago... So they obviously have more evidence on him.

The Phelps County Prosecutor filed the charge...not the Feds. The Feds don't handle homicides except in very rare instances.
Also, prosecutors file charges all the time on cases that are losers. They only need "probable cause", which is nowhere near "beyond a reasonable doubt."

The Federal Agents presented the case to the Prosecutor,
In this case they feel there is enough evidence to file charges.
The Prosecutor either throws a case out because of insufficient evidence or files charges.

That doesnt mean it won't be dropped at the preliminary hearing.
The preliminary decides if there is sufficient evidence to go to trial. Was dropped at preliminary last time.

Yes people go to bars to drink, but also to get together with friends, like my sister was there she dose not drink my cousin and alot of other people were there just having fun on a Saturday night so you have no right to say they weren't outstanding citizens, when you live in Newburg the pickings are slim as to where to go to have some fun with friends.
