What are the Laws on this?
I can home the other evening. As I got close to my driveway I saw a concrete truck dumping concrete in a part of my driveway(that is not used at this time). A Local Company had been putting concrete In My Neighbors newly dug up secspool. I went and ask the driver what he was doing dumping concrete On Private Property? He said that MY Neighbor said for him to dump it there. I WENT CRAZY ON THEM. MY Neighbor never did say Why he had told the driver to put the concrete there. Why didn't he put it on his property?
Who Pays for the clean Up? The Neighbor or The Local Company? Or Both? This has to be the Wildest thing that has ever happened to me.

What is your opinions on this?

This is a civil matter. The police won't do anything. But you have had a tort (wrong) done to you and you will win in court, if you do things right and can prove your case. The other side will also end up having to pay your legal fees.

I would call them and give them 48 hrs to clean it up. Send them a letter certified mail, return receipt requested as well.

Then, if they don't do it, hire a lawyer and file a lawsuit against them.

see if first you can work out an accomodation with the concrete company and keep records of that effort. You may save a lot of time and sweat.

How much was dumped? Estimated square footage?

Maybe you can get your main driveway concreted for free in stages using leftover concrete if you work out a reparations deal with the company. Turn lemons into lemonade and all that.

They can dump concrete in my driveway anytime they want. Would love to have it instead of a dusty gravel road.

The concrete was dumped over an imbankment were an old store had caved in not in ur driveway. Also the OWNER of the
house gave his permission for it to be dumped over the imbankment. Since you dont own the property and are moving out I guess it shouldnt matter. Also they are building an addition on there house its not a secspool. I dont understand why people get on here not telling all the FACTS and looking for sympathy or tryn to make a quick buck.Im not tryn to argue with u just tryn to tell all the facts.

Well My Dear Neighbor..The Home Owner was not Contacted Until the concrete was on the ground and only after I Raised Hell and Made You Call Him. Someday that will be My Driveway and I Don't Want it there. It is an Eyesore..Big Rocks and A Large Amount. If I had not Caught You All in the Act of Dumping. The Home Owner and Myself would have never known who did it. You have lived there what about 38-40 years now..Why would you want to Dump it in My Driveway. It is Not Off an Enbankment it in right the on level ground. I will take a picture of it tomorrow and put it on here for all to see. You Didn't want the Concrete on Your Land. So WHY Put it on Mine? I Don't Want it either.

Never Suprised, if it's not actually property you own then you can't bring a tort action in court.

I sympathize with you on this because I have had similar problems with neighbors dumping, but it sounds like you just got outmaneuvered by a wily old hillbilly.

It's not clear what your relationship is with the actual property owner.

If you are renting or leasing, you can tell the owner that the dumping is in violation of the lease since he has altered the condition of the property and you want him to clean it up.

If the land with the dump site is not part of what you are renting or leasing though I don't think you have any legal recourse here.

Yeah if you guys are friends it seems obvious you should have asked him rather than come here, that makes little sense. He may not be your friend after all, but you're not his either to come here first.

You started here asking what could be done about it legally. The answer is to bring a claim in court. You didn't say how can I resolve things with my friend. That is a new thing you are bringing up. Now you are complaining that I gave you the legal advice you requested. Whatever dude, you are an idiot. I'm no completely on the side of your concrete dumping neighbor, you probably deserved it.

I went straight to him and the first thing he said is,"Where you been, I haven't seen you in a while." That when I ask, He had No Answer. Cause he was caught Red Handed.
You spoke of court. I didn't want court. I just really wanted to know the law about dumping leftover concrete. I was just telling you that I didn't want it to go in that direction.
When I spoke with him I told him that the Land Owner would Cuss me Out for letting it happen, even thought I had no Control over it. That's just how the Land Owner is. I told him to go call him and he did. So it was you observer that jumped to a conclusion about the story. So who is the Real Idiot here. That's how some ppl on Topix are. Assuming what happened. Like I said He still hasn't said Why he dumped it on me instead of his land. He just walked away and said nothing.

You also Assumed that I came here first. Which I went straight to the Dump Truck and then here come the neigbor with, Oooh Where You Been. Don't matter where I have been. You just don't dump leftover concrete on your neighbors driveway.
He didn't dump it on his land cause it is an eyesore. So he thought that I had moved (which I had not) and he would just dump it on me. I came home at the right time.
The Lord works it to where you don't get away with anything.

Is he a redneck or a yankee. Most Yankee come down here and think they can do anything. Most southern has repect for others properties. Get a wheelbarrow and shove, pick up the concrete and put it on his front porch. My neighbor's dog sh!t in my yard, they got a pile of sh!t on their porch with a note to call me.
