Three girls (one of them has already been mentioned) took nude pics of themselves (which was nothing new) and sent them out to almost everyone on their contacts. Each of those people, in turn, sent it out to all their friends because it was funny to them that these girls were being so easy. One person thought it would be funny to send it to the prinipal's personal cell phone and then their parents were notified. Part of their punishment was supposed to be that all three were kicked off the cheerleading squad. The parents, however, thought this was too severe, especially since it didnt happen at school. Instead, all three girls were able to be viewed scantally dressed in front of every crowd at every game, but most already knew what they looked like naked anyway.
Now they are a running joke. they certainly have attention now, but I don't think it is the attention they wished they were getting come five years from now. They will be wishing people wanted to be around them because they liked them, not because they made themselves look very easy with low morals.

I would take them off the cheerleading squad, take their cells permantly till they turned 18 no car, and more if I had a child that had done this and I found out. Mistake or no freaking mistake, they by gosh wouldnt make that one again.. Any parent that would do less maybe should'nt be a parent. Its an embarresment to a parent and the child.
I know the parents both very well that you mentioned their names which I wont. The male was high society in school, football quarterback, but overall a good friendly guy that most liked. His wife I grew up near, but now she is got her nose up in the air and not like the person she was raised up as. and I know both their parents also. They are good people dont take me wrong. It their place to disclipine their kids in how they see fit. All I can say if it was my child she wouldnt ever be a cheerleader again till after she turned 18 and had moved out on her own. Call me what you want for my opinion but I plain and simple old fashioned. I know crap like this didnt happen without severre punishment when we was kids. The mother of the one mention had done something like that her mother and father would have done I dont know what to her.

Thats whats wrong with kids today. No damn dislipine and no respect for themselves.

Quite wining about people that have or had these pics. Its not like they went out looking for them or ask for them or illegally downloaded them. They was sent to them and for most it discusted them, that may be why they kept them or what the hell ever maybe to show parents that they knew these kids to have proof. WHO CARES thats not the point.
I personaly have not saw them nor do I want to nor care. just sick of the stupid people on here and their idiotic comments and bla bla f**king bla bulls**t. Not everyone, but we all know how to tell them apart soon as they type and post.

The only one thats really getting hurt here is the girls, maybe they don't see it yet but it's something that dosen't go away. Pictures are forever.

Irregardless of the theories here, POSSESSION OF PORNOGRAPHIC PHOTOS OF MINORS IS A FELONY. Doesn't matter that someone sent it to you, or youare just keeping it to look at for yourself and show and send to all the friends on your mailing list or the other excuses being made here. IT IS A FEDERAL CRIME.

I am not taking up for anyone or anything, just a question. If someone recieved the picture on pix message and did not know they were going to recieve it, would they be liable??? Just seems like it would be beyond the control of that recipient.

I am ashamed of the administration and the school board for allowing girls with such poor character to remain on the cheerleading squad. Even a small child knows it is wrong to take naked pictures of yourself and show them to other people. And I am ashamed of all the grown men in Rogersville who have that picture on their cell phones. But I'm not trying to deflect the blame. It belongs to the girls, the parents and the school, not to the idiotic and predictable male behavior of keeping and sending the picture.

I don't know the legal response to the question, but logic dictates that if you receive such a pic you should delete it immediately and by all means do not distribute it. I believe being caught with it or distributing it would be where the crime is.

I would like to know where the Hawkins Co. Sherifs Dept. and the Fedral are in this case? There has been more than one law broken if this is true.
I think some times some people get to break the law and get by with it or we would be reading about this in the Kingsport Times or the local News Station.

I am a mother of 2 girls at chs. Do not deceive yourselves, their are more students than these girls who act out in an overtly sexual manner. From my understanding, a lot of nastiness starts at the middle school level. And not just at lambasted rms, but at the city school as well. I would have liked to have seen the girls punished. I believe that chs and rms both do not handle discipline fairly. I know personally that neither school does much of nothing regarding bullying.

Surely Not, like it or not, it is a crime both to RECEIVE child porn, and to POSSESS it. The federal law here is Title 18, Part I, Chapter 110, section 2252:

If you did not KNOW that you received it - like a workman left it in your garage and you had no idea it was there, then you are not guilty of receiving it, but you are still guilty of possessing it.

Obviously if you find someone has send it, it is in your best interest to immediately delete it. You should certainly not save it and be showing it to all your friends, and forwarding it along.

I am pretty sure that the vast majority of people who received the child porn last year did NOT receive it directly from any of the girls involved. But be aware that it is ALSO a crime for a underage girl HERSELF to mail porn photos of her own self to anyone. In fact, a underage girl was only last year arrested, prosecuted for distribution of child porn, and is now a lifelong registered sex offender because she sent a nude photo of herself to her boyfriend.

Also, notice that in section 2252 subsection c.2, it is an acceptable defense if you either delete it promptly, retaining no copies OR promptly contact law enforcement and give them the photos.

Also, oddly, it seems in subsection c.1, you are allowed to possess 'less than three matters', which means one or two. Since there were three girls involved here, that is three matters, so subsection c.1 does not provide a defense.

OK be fore you get all hostile on me here!!! I never got a picture on my phone ok!! All I am saying is that for example some guys send a dirty or funny text to all the guys on their contact list. Whomever recieves that text cannot control that text being sent to them and they have no clue what it is until they open it. If they send it on then "yes" guilty as charged but if they do not send that on and delete it then I find that person as innocent. I know this kind of thing happens because I get texts sometimes that are distasteful that I would assume not recieve but I cant control what text is sent to me. At least as far as I know I cant. I was just curious thats all!!!

Maybe I should have said 'if a person did not know that a person received it' instead of 'if you did not know that you received it'. When I was talking about what the law says, I was using 'you' in the sense of a general person, not you specifically. Sorry for the confusion.

Yes, and that is what the law says about it as well, deleting it right away is a defense.

There was a case recently though where they found some blurry thumbnails in someone's web browser cache, pictures just a few pixels apart, and they still charged the guy. Presumably he had viewed some page with pictures, and did not save them or anything, but the browser cached the pictures, so he was tried and convicted. In fact, I think it was a dentist or veterinarian or somebody that lives in Gate City or something, it was in the local news. Now he is a registered sex offender even though he did not remember the pictures and obviously did not intentionally save them. So even if you are cautious, if some prosecutor has it in for you, you can get sent up the river.

That's asinine. Just another example of the stupidity of "Zero Tolerance" type laws. Now, don't get me wrong: Child porn is awful & reprehensible, but to catch someone in such a dubious manner is about as bad in my book. Two wrongs NEVER make a right, & the draconian nature of the punishment on child porn is also suspect in my book. Toss the book at the REAL bad eggs, for sure, but don't ruin a person's life over some technicality. And the girls who did this ? Typical stupid teenagers, not thinking. Are they guilty of a sex crime, to carry that burden around w/them from now on ? I don't think so. They need counselling, love, but not jail time.

Federal Law = 10 Years for transport of pics. by computer or cell phone, reason or law is "Interstate Commerce the phone used was more than likely not made in the U.S. and there for in was made out side of U.S. and that is were the 10 Yr's comes in at because the device wasn't made in the United States.
# 2 OK the other Federal charge that Carrie a least 5 yrs for Sexual Exp. Pics on an Minor on a PC or camera phone ,doesn't matter it's on Electronic Images. I don't care if you Delete it right away or not, you would have to take it Straight to Law Infor. RIGHT then to not be charged. All the Judge would say is " You should have Better Friends than that to send you such Child Porn. By Law That's what it is called, IN Court and the charges you will be charged with.
I will get back to you guys and give word for word from these laws and the code so you also can know the Law. IT IS VERY SERIOUS!!! And CAN be Prosecuted to the fullest by the Federal Court Laws.
