A child must be protected under these Child Passenger Protection Act guidelines:

-under the age of eight, secure in a child safety seat.

-eight years of age or more, but less than 16 must be secured in a seat belt or child safety seat.

Parents or legal guardians of a child under eight are responsible for providing an approved child safety seat to anyone who transports his or her child.

the penalty for failure to comply with this law:
violation of this act is a petty offense, first violation shall be punishable by a fine of not more than $50, waived upon proof of possession of an approved child passenger restraint system defined under this act. A subsequent violation of this Act is a petty offense punishable by a fine of not more than $100.

BP duh the car did not hurt the kid ....it seems he was or may have not been belted in. One would need the whole story.

And to coster ninja thanks for the law review at seven this kid may just have unseatbelted himself maybe he was mad at his mom and tried to get out of the car as it was moving.

"The boy" was not belted in. One simple mistake. He was putting on his seat belt as *we*- yes we pulled out of the driveway. He was leaning on the door which opened, allowing him to fall from the car. I was parked at the end of the driveway and pulled out into the road. I did not run him over. He was however pinched on the left side of his body by the tire.(he had right rib fractures, his right lung was collapsed and his liver was bleeding) It infuriates me that it was portrayed to be something which it was not. Why is there nothing in this story about how it was off of a main road yet the ambulance, police and firetruck drove past the accident? Or how about the fact that the car was just purchased the friday before, and it was my first time driving it? The salesman told us that the passenger side doorhandle did not sit flat, but not about the fact that the door didn't latch along with it?

Obviously there's always more to the "story" than the news allows you to believe.

Anyways. Yes my son is doing fine, thanks to Rockford Memorial Hospital and their wonderful surgeons, doctors and nurses. He is almost fully recovered, just using a walker which a fracture in his sacral recovers.
