Yup, and plan on it costing about $3,000 -$5,000 to defend your drunk ass if you insist you're innocent. If you're lucky, that will buy you a DWAI (even if you really are innocent!). If you don't have credit or access to those funds, you might as well just admit your guilt and throw yourself at the mercy of the court. At the least, my bet is this chick is going to be convicted of DWI based simply on the Trooper's testimony. It doesn't matter that she didn't take the tests. She's already lost her license for a year and pissed off the cops. This girl is going down for DWI and all her traffic infractions. Over 100 mph!!! She deserves it. She could have killed herself or someone else.

The law says the officer can still charge you with DWI based on their observations. Look it up.

Officers are trained to observe bevavior associated with inebriation. Look it up.

Refusal to take a breath test is given as consciousness of guilt evidence. Look it up.

Of you ate charged with DWI, you are arrested and booked. Look it up.

Again, the lack of common sense is an indictment of the parents and education system on this state...

Nope. It doesn't quite work that way. I often agree with you, but not this time. While you are in the backseat of the cop car, the other cop takes it upon him/herself to search your car. Your post is completely fantasy world.

Unless it was a felony stop, they have no right to search your car without your permission for a traffic violation.

I think if they are arresting you and taking you into custody, they can search the car but not locked areas of the car like the glove box or trunk, for those locked area they would need a search warrant.
But the RPD doesn't follow laws and do what ever they want.

If you look at the picture in this stories, it shows that the cops were able to get the meat in the truck by folding the seat down. Other wise, even if they had the keys, they would need a search warrant to open a locked trunk.

It happens all the time. they search the car whether they have the legal right to do so or not.
