She's out on a $ 50,000 bail you idiot, she's not free, there are stipulations to her release and the conviction will not be overturned. The sentence will be reduced but her attorney is not looking for her conviction to be tossed out, he is appealing because this is her first offense and felt the sentence that was handed down was too harsh.

New York Appellate Division Justice Rose Sconiers ordered that Simmons' sentence be stayed pending a hearing on her attorneys' appeal, which argues her sentence of five years in prison is overly harsh considering that Simmons is a first-time offender. This is what made it possible for Simmons' release this afternoon.

Let me know when you pull your head out of your a**.....WOW, you are truly and ignorant POS.

Stop picking and choosing what you think is gonna fit your agenda. She is out on bail, she is not free to leave the country or the state during her appeal process unless approved by the court, which isn't going to happen. The only thing here is she is waiting to see if the sentence was in fact too harsh or it wasn't. She has already been convicted of the crime you idiot. If the sentence is deemed too harsh she will be re-sentenced, it's pretty simple. I never said if she was re-sentenced that she would have to go back to jail. If the sentence if found to be fair and just she will be going to prison. If it's too harsh she could get probation with no time in jail or prison.
