No, go look at the link. What you are describing is called criminal trespass. States like Florida include what is called curtilage IF the property is completely enclosed by a fence. New York's penal code does include the curtilage clause. Your definition of burglary is incorrect by dictionary and N.Y. penal code definition.

We are not in florida.

If you tell someone to get off your property and they stay on, they can be charged with criminal trespass. You don't have to commit a crime on the property to be charged with criminal trespass.
And if a person enter a property with intent to commit a crime it is then call burglary.

I know we are not in Florida. Never said we are or that Florida law pertains to us. Learn eading comprehension. Stealing from a yard is not burglary in N.Y..
