Stacey,

Sounds to me that your nose is out of joint. While there are circumstances from time to time that come up that might circumvent the for sale by owner section of CL. However the dealers who are posting countless cars over and over again simply do not fall into this scenario.

Just post your crappy auction cars where they belong under the dealer section and this topic goes away.

Sounds simple to me !!

I predict that sooner rather than later CL is just going to charge both owners and dealers to advertise. They know that even at 5 dollars per ad it is a good deal compared to what the newspaper charges.

That way it will not matter where cars are listed and it will be in 1 cleaner less spam listing moving forward.

An owner I suspect will gladly pay the fee and the low end dealers simply will stop advertising.

@Kimberly...
That wont stop the low end, auction buying, ripoff, dealers.from posting in the by owners, private party, listings...they get WAY more activity there than in the by dealers area..The junk thay are selling, the real dealers sent to tbe auction instead of trying to sell.

Well it is starting to get noticed as even software companies that help honest dealers advertise are now talking about this issue

Well on Cl in the "dealer" section I clicked on the first one, and I don't see dealership name or dealer facility ID number ?? So will you report them and will they face fines???
Are you sure the CL counts as "advertising"???

i'm not going to report the dealer. But if someone does and DMV investigates, the dealer can face sanctions for not including name or ID number in the ad. Yes, CL IS advertising.

As for the rest of your questions, there are DMV/Vehicle Safety NYS laws that deals with ALL of those scenarios.

For example, it's illegal to flip a car from one person to another with the original title when the car was sold to someone else.

And if f gramma takes her car to a dealer to sell it, it is on consignement and is considered a dealer car as long as the dealer controls it on is lot and therefore subject to all dealer regulations.

I posted the link to the Dealer regs on this discussion so if you want the answers to your questions, just look there and you will get an education in the used car gig from the NYS law perspective.

A repair shop owner would not have a title for the car put in his name cause he wouldn't be registering the car.
You have no clue in what you are talking about, and instead of me teaching you everything, why don't you go and get up to date on that before you go on here talking a bunch of stuff that is not true and only makes you look stupid?
Maybe you should get "spell check" on your computer too, cause I can't understand why you allow your comments to be submitted with soo many words underlined in red to all of us. It only makes you look stupider then your commits make you look.
You don't need to register the car to get the title. You can title it without registering it.

Dealers will still post in the owners section to get more calls form those who do not want to call dealers. They were doing it long before CL started charging for the dealers section.

And by the way, as a dealer for 20 years I can tell you that there were many good cars that got through the auctions. Almost all of the good came from the new car dealers who wholesaled them not because they were problem cars but cuz they didn't meet thier marketing criteria for age, mileage, make, model, etc, or just cuz their lot was full!!! Early on, one of may rules was to buy ONLY from the new car dealers (unless I knew the independed dealer well) since their stock was much better and most were very good about problem children since they wanted your repeat business.

Back before the recession killed the new car and trade in market along with cash 4 clunkers pulling 750,000 low end used cars out of the system, it was relatively easy to just go to the auctions and find a few good cars to buy, put a few bucks into them and sell to a satisfied customer.

It's not as easy as it used to b to find good auction cars, but it can still be done but at a much higher price than in the past.

If the dealers played by the rules on cl, they would have to raise the price of the car.
Do you want to pay more for the car or less?

Cl didn't get no message, they just change the word flag to prohibited.

And if stupid one can figure out which one is a dealer then so can all the other consumers.

Ok, Statistics bare out that most people selling a car from their driveway are doing so because that vehicle has an issue that cost on average over $1400. The private seller has no problem covering up that issue to "get rid" of the problem from their pocket book. You see, the private owner is only going to sell one car and has no worry of being reported to a consumer group. A dealer would like to sell more than the one car, in fact his very living depends on that fact. The private seller just needs the money fo move on. As for the legality of listing under by owner, I can state solidly it is not illegal. You could however find civil president to file a legal action should the dealer not provide what they advertised. You see the dealer has no choice but to handle the sale as a dealer by completing all the documentation of the sale. As stated before, you would know in advance of the sale it was a dealer sale. It might be inconvenient for you to have driven to see the car only to find the dealer is the "Owner", but not illegal. The idea of a dealer being a risky seller is actually the inverse as the statistics show. Legality only comes into play if the person selling the vehicle has no legal ownership, all dealers own their cars. The statement above regarding the "Car Flipper" is the real menus to Craigslist ads. These people have no problem taking your hard earned money and providing you with JUNK.
