Recently, when I paid All Star Concrete in Ridgeway, SC, a driveway contractor, close to $5,000 to replace my driveway and walkway, I assumed that he would do the work satisfactorily, and that I would have recourse if he did not. I was wrong on both accounts. Work that was done was unsatisfactory: riddled with mistakes and already cracking. The job was also not completed. I sued, and the Magistrate entered a judgment of $2,460 against Mr. Reuben M. Simpson of Ridgeway, SC, but he refuses to pay it. The contractor has made a lien difficult by not having his assets in his or his wife’s name. When I checked with the Department of Consumer Affairs, I learned that they would try to intervene but they have gotten no response from the contractor. South Carolina needs to better protect consumers from those who do not provide the services promised. Perhaps contractors should be forced to escrow payments or post a bond so that, if they fail to perform satisfactorily, the consumer's money would be refunded.
