The Gov & AG should simply refuse to defend the unconstitutional ban.

It would then be a repeat of California's Prop 8, and welcome Virginia to the equality club!!

Summary judgment in favor of the plaintiffs.

Why would you say that?

The 14th Amendment includes the word equality in Section 1, which prohibits a state government from denying “to any person within its jurisdiction the equal protection of the laws.” This equal protection clause protects individuals from arbitrary discrimination by government officials. Federal courts have read the equal protection concept into their interpretation of the due process clause of the 5th Amendment, thereby applying the equal protection limitations to the federal government. Neither federal nor state governments may classify people in ways that violate their liberties or rights under the U.S. Constitution.

Remember far righters only care about one amendment..The 2nd. And the 1st they twist to think it means they can force at gun point there religion on to others...

But the rest of the Constitution to far righters is evil.

But there IS an equal protection clause, which is why the judges are now overturning these bans.

Just 10 days to marriage equality in Virginia?

If the Gov & AG do the right thing and refuse to defend the Virginia ban in court, there will be no reason to issue a stay of the summary judgment, so same-sex couples should be able to start marrying in Virginia next month!

For the record, the previous Republican AG in Virginia (Cuccinelli) refused to defend legislation which he believed was unconstitutional.

Typical hypocrisy to now claim the current AG must defend all laws.

And of course the GOP controlled legislature is attempting to pass a law allowing themselves to defend laws in court if the Gov and/or AG won't.

Well equality for some, not all. The sister-wife Mormons are still discriminated against.

What gives a Federal Court the authority to ignore the wishes of the ppl. who voted to ban that nasty gay shyt? Its what the voters decided to in banning gay marriage. VA is not going along with those sodomites......if we do we'll have hell to pay.

Who decided 'one other'? Wasn't it the same people who said it could only be 1 man and 1 woman?

The US Constitution.

Same reason you bigots can't vote to keep blacks in slavery anymore or ban inter-racial marriage.

One way or another Virginia will be forced to allow same-sex couples to exercise their right to marry.

The Gov & AG will simply refuse to defend the ban in court and it's over.

Society.

If society ever changes enough to accept polygamy, then it will become legal as well.

Until then it won't.
