Court tacks year to man's 75-year sentence

A man serving a 75-year sentence for two counts of attempted murder was given an additional year in prison after entering into a plea agreement for a charge of criminal recklessness.

Chad D. Malone, 21, of Richmond, was charged with criminal recklessness after pointing a gun at his girlfriend, Valerie Grubbs, during an incident in April 2011, according to an affidavit of probable cause.

Wayne County Circuit Court Judge David A. Kolger accepted a plea agreement Friday that requires Malone to serve one year for his guilty plea to the Class D felony count.

While out on bond for the criminal recklessness charge, a no-contact order was issued preventing Malone from having contact with Grubbs.

In September 2011, Malone shot at two individuals while they waited in the drive-through of the downtown McDonaldÂ’s in Richmond, and Grubbs was identified by authorities as the driver of the vehicle Malone was riding in at the time of the shooting.

Malone was found guilty in December by a jury of two counts of attempted murder, and Grubbs testified that she was driving the vehicle when Malone pulled out a gun and shot at the two victims, who suffered minor injuries. Malone was sentenced to 75 years in prison on the attempted murder convictions and is serving time in the Indiana Department of Corrections facility in Wabash.

The one-year sentence accepted Friday is required to be served consecutively to the 75 years in the shooting case since Malone was on bond at the time the shooting occurred.

Grubbs also was charged with two counts of attempted murder for the incident at McDonaldÂ’s. The state of Indiana last week withdrew a plea agreement in that case that would have seen Grubbs sentenced to 10 years in prison with two suspended for each guilty plea of attempted aggravated battery (a Class B felony). Grubbs will face trial May 28.

She is 30, he is 21. They've been together for years and have a child together. (Too bad she was never charged with statutory rape.) SHE RAISED HIM from a boy to be what she wanted, yet threw him under the bus in her testimony. I finally exhaled when the State rejected her plea deal. She's good at playing innocent, but someone was paying attention to her scam. (I'm NOT saying he was innocent either. No way.) Our Bonnie and Clyde need hard time and so glad they're BOTH going to get it. I'll be watching closely when her trial starts. Can only pray that justice is served to her too
