Is it possible to sue for emotional distress when a company will not leave me alone?I had a bundle with Windstream and Dish Network. I canceled my account in July and since these companies bill a month in advance they needed to credit my account for services that I did not use. Windstream is the billing company and they credited my account but Dish Network failed to do so. So I kept receiving bills from Windstream and since July I have spent about a eight hours on the phone trying to settle this dispute.
I have finally got Windstream and Dish Network to communicate with each other and found that communication between the two somehow stopped.
I finally contacted Better Business Bureau and the Customer Service Rep. failed to communicate with Dish Network and continued to say that I had to pay my bill with Dish.
I got a phone call about two weeks ago from Dish saying that this is a situation that they have never seen and that they were sending me a check to cover my costs with Windstream. I said that is fine and I wanted to make sure that I would not be sent to collections because I was constantly being sent letters stating that I would. Well today I got the phone call from a threatening collector. I could not believe that I was getting a phone call from him and told him that I could not believe that I was and he said "believe it" and demanded that I pay for the bill. I told him that I could not pay for it because I did not have the money for it and then he said that I could post date a check. I further told hime that I am not giving him any money that is not due to him because it is not my problem and he said that "it was my problem and I needed to take care of it and pay my bill". I have never been sent to a collections agency and I am extremely upset that I am being treated in the way that I am. I think I paid my Windstream bill late once and when I realized that it was late I paid it immediately. I am being treated so unfairly and being put through so much stress and this is taking up so much of my personal time I would hope that there would be a way to be reimbursed for this? Can anyone help?.
