What does the county attorney's performance have to do with law enforcement?(RE: oh yeah's comment). My understanding is that it is the county attorneys responsibility to issue warrants and summons. All law enforcement does (both county and state) is serve what comes out of the CA's office. Should most of the warrants be criminal summons? Yes. Should everyone be treated equally regardless of their position as a county employee (i.e. magistrate)? Yes. Especially when their actions were that of a private citizen, and not in the capacity of their job. Can law enforcement arrest someone for a misdemeanor that wasn't committed in their presence? With a very few exceptions, NO! Is it possible for law enforcement to "investigate" he said/she said situations? NO! The law enforcement folks do not issue paperwork as it pertains to summons and warrants. Only the county attorney does. If there is any paperwork messed up, it don't come from law enforcement. You would think a county attorney would at least know the law and how it applies. If Joe Blow goes to the county attorney's office and says Jane Doe threatened him, an arrest warrant is issued on Jane Doe for Terroristic Threatening, regardless of her innocence or guilt (a summons would be the correct thing to do). If two families come in and say that Mr. I'm Important assaulted their children, and have witnesses, the county attorney will refuse to even issue a summons. Instead she'll insist that law enforcement should have "investigated" something that didn't happen in their presence, or should have arrested Mr. Important for a misdemeanor that didn't happen in their presence. The CA's job is to see that all citizens have their day in court. Yes, a person is innocent until proven guilty. But a party that has been wronged should at least have the opportunity to have their case heard by a jury of their peers. As a reference for how things are supposed to be done in Kentucky, see the Jefferson County Sheriff's website at http://www.jcsoky.org/warr_epo.htm and you can clearly see that the county attorney has the sole responsibility for issuing of warrants and summons. I have to put the link to another counties standard procedures because ours doesn't have one. Good job? To some extent, yes. To another extent, No.

I think she is because she is very professional and without a lot of background she is very quick to understand the cases presented, so that makes her very intelligent! Go Michelle!!

You can always go lie and get a warrant, but you are the one doing something wrong by swearing under oath that something happened when it didn't, not her. Course you are going to have to explain yourself to the judge later. Her job is to issue warrants not deside if you are telling the truth thats what the judge does.
