A woman who raised allegations about Rialto police officers having sex with strippers at a police union building has filed a $500,000 claim against the city.
The claim by Nancy Holtgreve, a waitress at the Spearmint Rhino strip club, describes police officers engaging in group sex at the police union building with female employees from the club. She accuses the city of fostering and perpetuating a culture of sexual harassment by police officers.
In her claim filed Wednesday, Holtgreve said she was impregnated by James Dobbs, a Rialto police officer whom she accuses of harassing and abusing her after she had the baby and sought child support.
Her attorney, Danuta Tuszynska, of Riverside, said Holtgreve asked for assistance from police and city officials about the conduct but was ignored.
"She has been continually threatened and abused by Dobbs," she said. "It's time for this conduct to stop."
Efforts to reach Dobbs were unsuccessful. A Police Department spokesman referred questions to the city attorney and said he could not pass a message on to Dobbs.
Last month, Rialto Police Chief Mark Kling announced a personnel investigation and placed four police officers on paid administrative leave after Holtgreve came forward with the allegations.
Jimmy Gutierrez, Rialto's city attorney, said he plans to return the claim as untimely and insufficient. He said the events described in the claim took place in 2008 and 2009 and involved consensual acts.
Gutierrez said the claim fails to establish a violation of state law by the city that damaged Holtgreve.
"All I can see is a series of events they admit to and then they say 'City, give me half a million dollars,' " he said. "That doesn't cut it."
Holtgreve said she began dating Dobbs in late 2008 or early 2009. They would have sex at the Rialto Police Benefits Association building, sometimes while he was on duty, she states in the claim.
She said officers frequented the strip club and made arrangements to have sex with female employees at the police union building. Occasionally several of them would have sex together, she said.
Since the allegations were raised, the union has changed its procedures so that union members no longer each have a key to the building and are granted access only for legitimate business.

RIALTO - A woman's allegations that she had sex with a police officer while he was on duty has led Police Chief Mark Kling to place four officers on paid administrative leave while the Police Department investigates misconduct within its ranks.
Nancy Holtgreve, a 38-year-old waitress, said she had sex with Officer James Dobbs three times last year at the Rialto Police Benefit Association's union building after she clocked off work in the early morning and while Dobbs was on shift for the department.
"It was at the police union building and anyone that belongs to the union has a key," Holtgreve said. "This is where we would go."
Holtgreve said she brought the allegations to the department in May because she feared for her safety after Dobbs allegedly abused and threatened her when she demanded he pay child support for a son they had in April.
Holtgreve said after she told Dobbs in August that she was pregnant with their son, an enraged Dobbs verbally and physically abused her because he did not want their relationship or the birth of their son to affect a custody battle with his ex-wife, or a relationship he was having with another woman, who Holtgreve alleges is a secretary in the department.
Dobbs had kept secret his alleged relationship with the secretary until he found out about the pregnancy, Holtgreve said.
"Our agreement was I was going to have the baby and he would support me," Holtgreve said. "He would tell his ex-wife and the secretary. When I said it was time to tell your family, that's when push came to shove, and he didn't want to pay child support."
Phone messages to Dobbs were unreturned.
A phone message to Dobbs through his father in Northern California also was not returned.
Kling said he launched the investigation immediately upon Holtgreve's allegations.
"This is not representative of this department," Kling said. "We are going to hold these officers accountable if these allegations are true. And if the allegations aren't true, we are going to do everything we can to clear their names."
The department's investigation led to six officers who might have been involved in misconduct, but only the four have been placed on paid leave, Kling said.
Kling said he could not confirm the names of the officers on leave because it would compromise the investigation.
Kling also would not confirm how many people the department has spoken to in addition to Holtgreve.
Holtgreve said she met Dobbs in 2007.
She said she and her co-workers after shifts frequently met with Dobbs and other officers at a 24-hour restaurant in the city.
Holtgreve said when they started dating, Dobbs, sometimes dressed in his police uniform, would suggest they meet for sex at the union building.
Sgt. Richard Royce, president of the union, did not return calls seeking comment.
Kling said that prior to the investigation, the department had been in the process of installing vehicle locators on all of its patrol cars, which allow supervisors to pinpoint where officers are during a shift.

RIALTO - The police officer allegedly at the center of a sex scandal that has rocked the Rialto Police Department is off the force, police officials said Friday.
"I can confirm that James Dobbs is no longer employed by the Rialto Police Department," Police Chief Mark Kling said Friday. Kling confirmed that Dobbs' last day was Aug. 12, but would not confirm if Dobbs resigned or was fired.
Dobbs has been named in a $500,000 claim filed against the city by a strip club worker who says she had sex with on-duty cops and also was involved in group sex parties at the Rialto Police Benefit Association's union hall.
Now that Dobbs has left the department, how he left could play a big factor in whether he ever wears another department's badge.
"It's hard to say because every department has the standards that they want to bring their people in on," said Ron Cottingham, president of the Peace Officers Research Association of California.
Dobbs has been singled out by Nancy Holtgreve, a drink server at the Spearmint Rhino who alleges in her claim that several female employees of the club and several officers would engage in sex together at the hall.
She also alleges that she had sex with Dobbs and Lamont Quarker while the officers were duty. Holtgreve says she had sex with Quarker, a narcotics officer, in the department's narcotics office.
She says she has DNA evidence that Dobbs fathered a son she gave birth to in March.
According to the claim, after Holtgreve gave birth to her son, Dobbs used his position as a peace officer to intimidate and threaten her.
She alleges that Dobbs physically abused her and was violent toward her on many occasions.
According to Holtgreve, Dobbs became enraged when she demanded he pay child support, because he didn't want his relationship with Holtgreve to hurt a custody battle with his ex-wife, or an alleged relationship with a woman who works in the police department.
Holtgreve says she went to the department for protection from Dobbs, but they failed to protect her.
Holtgreve alleges that the city fostered and perpetuated a culture of unwanted sexual harassment of women by male police officers.
The claim also alleges that the department and the city were aware that Dobbs was terminated from the California Highway Patrol because of allegations of dishonesty.
Earlier this month, the city in a letter to Danuta W. Tuszynska, a Riverside-based attorney representing Holtgreve, rejected much of the claim, saying it was not filed within six months of when many of the alleged incidents took place.
Tuszynska says the claim focuses on the events which allegedly occurred after Holtgreve's son was born in March.
That part of the claim is deficient and must be amended and re-submitted or no action will be taken, according to the city.
City Attorney Jimmy Gutierrez, in a second letter to Tuszynska, wrote that Holtgreve's claim doesn't provide enough details about alleged acts of misconduct by the department's officers.
"Knowing that will tell me whether there is a valid legal claim against the city," Gutierrez said Thursday.
In a letter to Gutierrez dated Aug. 17, Tuszynska wrote: "I find it disappointing that the revenues of the City of Rialto were wasted parsing the language of a simple tort claim, and I suspect only my client's claim has been singled out for such scrutiny."
Tuszynska wrote "there is simply no legal basis for your requests," and informed Gutierrez that his requests will be addressed in a civil complaint, not a tort claim.
Gutierrez's letter, which was dated Aug. 10, gave Tuszynska 15 days to amend the claim.

Though it has not been confirmed if the employees of the Spearmint Rhino on Riverside Avenue were strippers, it has been confirmed that Rialto officers were involved with them. One club worker, 37-year-old Nancy Holtgreve, met Officer James Dobbs when she was a server there, and claims she had sex with him " three times last year at the Rialto Police Benefit Association's union hall after she left work and while Dobbs was on duty."
Though there are beds at the union hall, they are there for use by officers between shifts or off-duty as a benefit of the dues they pay. These allegations have prompted funding for new locks and a surveillance system to be installed at the facility.
Holtgreve says she came forward after becoming fearful for her personal safety when "Dobbs allegedly abused and threatened her after she demanded he pay child support for their three-month-old son."
All other parties involved or implicated, from the police union to the Spearmint Rhino's CEO, say they were not aware of the allegations. Meanwhile, 4 officers have been put on administrative leave as the investigation continues.

Rialto police officers had group sex with employees of the Spearmint Rhino Gentlemen's Club at the police narcotics office and the police union headquarters, according to a claim filed against the Inland Empire city.
Nancy Holtgreve, a server at the club, says that more than two officers engaged in sexual conduct with strip club employees, and that one officer used the department's narcotics office for sexual liaisons during the last two years. Her relationship with one officer soured when she got pregnant, she alleges, and the officer began threatening her.

The claim filed Monday alleges that the behavior "fostered and perpetuated a culture of unwanted sexual harassment of females by male police officers."
"This sexual behavior happened on duty and off duty," Danuta Tuszynska, Holtgreve's attorney, said Friday. "I have a picture of an officer exposing himself in his uniform … I don't know how the chief and bosses couldn't know about it in such a small department."
Tuszynska declined to make her client available for an interview.
Police Chief Mark Kling said the department has been investigating the allegations since they were reported May 5.
"I've placed four officers on administrative leave and two others are under investigation," he said, adding that he hoped to complete the inquiry this month.
City Atty. Jimmy Gutierrez said Holtgreve's claim will be rejected by the city as untimely and without merit because the acts were consensual. "She claimed she had consensual sex with two men.… She had a child with one of the men," he said. "She did not file any police reports with the city or city she lives in alleging she was threatened."
The allegations come five years after the Police Department of this diverse city was nearly disbanded amid allegations of racism and sexism.
Holtgreve, 37, alleges that the misconduct began in 2008 when officers started hanging out in the Spearmint Rhino, then arranged to rendezvous at a nearby Denny's. Officer James Dobbs started taking her to the union hall of the Rialto Police Benefit Assn. for sex, according to the $500,000 claim, a required precursor to a lawsuit against a government agency
"Occasionally several employees of the Rhino and several officers would engage in sexual relations at the union together," according to the claim. She also alleged that Dobbs introduced her to a narcotics officer who had sexual relations with her at the department narcotics office.
Holtgreve became pregnant by Dobbs and had a child last March, according to the claim.
Holtgreve alleges that during the pregnancy he began to "intimidate and threaten" her with calls and texts, stating in one message, "I'm going to make you look like an unfit mother, you ruined my life…. I'm a cop" and "You should have had an abortion."
According to the claim, the officer also "physically abused" Holtgreve on several occasions.
The claim said she went to the Rialto Police Department in late April and spoke to internal affairs, Holtgreve alleged. Holtgreve said she spoke to Kling, who she claims apologized for the circumstances and said, "We'll protect you Nancy, please don't take it to the press.
Dobbs could not be reached for comment.

I used to live in Rialto.
I loved that i could go freely around the city and NEVER see a cop...,
but when i did see them , they were usually raiding my house and stealing my money and some property.
Crooked. Good for nothing cops. Im not just being a hater , i speak from many many run in's with these "fake" police officers, and my friends.
Not to mention crap attitudes and no respect for the people in thier patrol areas.
But , as a daily redlight running speeder that doesnt like police , id still live there again for the fact you dont get rolled unless your actually doing "major" things.
If you live in Rialto, count the times you see a officer , im sure youll see its not alot ,.. if any at all.
Taking breaks, hiding out with other officers doing drugs, drinking, thinking of the next person they can jack . Rialto Police.

I feel that if Rialto PD are supposed to fight crime but at the same time they don't fallow their procedures than when they try to enforce the law it makes no sense because they are participating in what their beleives are but yeah when they prosecute an individual that is not breaking the law Rialto PD react towards the individual if he was the worse criminal ever and the law is enforce on that person but yea if the law enforcement commits a violation and when they get question about it they can provide the same action on themselves even though they know they are in the wrong but againts a regular citizen they abuse their authority to the maximum honesty I don't even feel save against the law enforcement PD

Most cops are worthless nowadays. They don't help when you call about drugdealers right out in broad daylight dealing. Car is totaled, won't come out. Report that an elderly womwn, possibly pn drugs, drunk? driving with her side door open because she can't see very well. They say they have to see her doing this. Call about speeders , rarely a ticket given out. What the hell are they doing? Used to have more respect for the police. Mostly worthless now.
