Bicyclist, 14, faulted for Redwood City crash that killed her, police say

Police will not seek criminal charges against the driver who collided fatally with a 14-year-old girl riding her bike to school in November because she was at fault for the crash, authorities said Thursday.

There is no right-hand turn lane at the intersection in question. The truck driver had a responsibility to be aware of either a pedestrian or cyclist on his or her right side when making the right turn. The assumption, seeing someone there on a bike, should have been that the bike was going straight and that a right-hand-turn would cut the cyclist or pedestrian off.

I cannot accept the "cyclist at fault" argument here. There was ample opportunity for a motorist to discover a reason to not make that right hand turn at that time.

This finding compounds the tragedy. The truck driver obviously passed the cyclist and turned in front of her. This happens to cyclists daily. Too bad this perhaps inexperienced or naive young woman didn't realize a driver can pass you one second and forget about you the next. Even when the cylist is wary, we can't alway slam on our brakes in time to avoid the vehicle that is suddenly moving into our path. Then the report of the accident blames the cyclist for bizarrely riding into the motor vehicle.

My heart goes out to the family.
