We always had the right to carry a gun as long as it was not concealed and you were not a felon or did something otherwise to warrant your constitutional right to be taken away. Concealed weapons are what you had to have a permit for. My husband was pulled over by a cop a few years later and had a 9mm laying on the dash. He informed the cop when he approached his door that he had a gun and it was in plain sight. The cop told him that he had the right to do what he was doing but to keep other people from getting out of their heads he would advise him to go ahead and cover it up in the seat.(which he had a point but he was telling my husband to actually break the law, very unprofessional. As not to ruffle feather's my husband just went and got his permit.) He let him go after they had a conversation and told him to have a good day. This was in Paragould city limit's. It's people that are uneducated that don't understand that we have a right to bare arms. The Law before just stated that you could not conceal it. Basically everyone had the right to know you had a gun by vision. If you wanted to conceal it then you needed a permit to carry. Now it says you do not need a permit to carry. The law leaves it up to the courts to prove that you were carrying with the intent to hurt someone. I've read the law to and researched the first 20 articles on google breaking it down. Now if you're going to leave the state you must have a permit from Arkansas and only go to the states that except our permit. Like MO. I'm not looking up the other states just to further educate you, you need to do your own research, especially if you didn't know we always could walk around with a gun on our side and it be legal as long as there was no intent to harm. As one article said " The Gov't works for us, not the other way around". Now there are exemptions to this, i'm talking about people that have no problems with being in trouble and and not had their right taken away, which is the only way they can take away that right. We have the freedom we do because of the Constitution. Whether you believe people should not walk around with a gun then that is your belief but you can't change the paper that made us who we are and all the people that have died to make it happen. If so then all those that died for this country their death's would all be in vain. I agree, do read the law and do some research but come the day in July when the new amended law comes into effect I will be carrying my 38 special in my purse.

does this mean people can carry weapons out in the open now? I'm ready to buy a holster and start carrying my 45 pistols just like the cowboys did.

so you're saying we could always carry in the open but I asked a local police officer and he said anyone caught carrying in the open would be arrested, I'm confused!

I'm borrowing this post from the thread on Paragould's topix:

"Arkansas Code 5-73-119(e)(7) already allowed for citizens to carry a gun while on a “journey”. Some have believed that this permitted open carry all along. Act 746 defines a the vague term “journey” as “travel beyond the county in which a person lives.” The statute does not specify that the gun must be concealed. Arkansas Code 5-73-120 defines carrying a gun as “on or about his or her person” or in a vehicle or otherwise readily available. Many gun rights advocates take this to mean that as long as a person legally possesses a gun, they may carry it in whichever manner they choose.

Act 746 also added language to 5-73-120 that allows for the carrying of firearms in self-defense. Previous wording of the statute was vague and made it a crime to carry a gun if it was intended to be used on another person, even in self-defense, without a concealed carry permit. The bill now adds the words “to unlawfully” use a weapon against another person. Self-defense is legal in Arkansas; therefore the use of a gun in an attempt to defend oneself would not be unlawful.

You need to read both acts and the link at the bottom. This post explains it the best that I've found. The only thing I want to point out again is the part about the fact that you are carrying with only the intent for self defense. The Act leaves it up to the DA to determine the intent behind the carry. The Act also does not say it has to be concealed, which is why it is now "Constitutional Carry". Google and read before you do anything .

I actually wrote the post quoted in #8, people have been copying it all over the different town's fourm's. I did all my research but do not let what I wrote determine what you do. Please do your own research.

I also will be talking to the DA myself before I do carry my 38, concealed or not. I suggest you all do the same. Yes we have the right to carry but I've been screwed over by the law before. I'm a housewife that has never had a ticket until a few years back and because of someone known higher in the community did something that could have gotten their kids taken away they blamed it on me and I was charged, and convicted with a lawyer and I was as innocent as they come. LE (Law Enforcement) does what they want, especially around here.

I had already decided to get my permit way before this happened, and I still plan to get it. "Open carry or Constitutional carry" Lawyer's are expensive, even when you're in the right.

If you still don't understand the past law vs. new law plz ask again. Maybe someone else can explain it better. Also remember everyone that post on here doesn't know their behinds from a hole in the ground, don't believe it all. Use Common Sense 99% of the time.

On August 16, 2013, Act 746 will take effect in Arkansas, which many believe will allow for open carry of a firearm. Signed into law by Governor Beebe on April 4, 2013, Act 746 is the result of HB 1700, which made technical clarifications to existing Arkansas statutes. The two most notable changes are the definition of the word “journey”, and language that allows for self-defense. While certain clauses of the law deal specifically with concealed carry, there is no language in regards to open carry that can be construed as specifically denying it.

According to the attorney general you can openly carry while on a journey. From rector to paragould? should be able to but if a smart butt cop stops you he may not think the distance is far enough and you will have to hire an attorney to 9099beat it.IMHO
