The state is paying $525,000 and a private agency $100,000 to settle a wrongful-death lawsuit over the murder of 2-year-old Kelsey Smith-Briggs. The girl died October 11, 2005, at her home near Meeker in what became a high-profile case after the Department of Human Services was found to have made a series of mistakes in the abused child's case.

This proves without a doubt that DHS failed Kelsey, for all those of you who have stuck up for Raye and DHS!

I fully agree with Lance, Raye shouldn't receive one red cent of that money. That would be a slap in Kelsey's face, IMO!

My heart goes out to you forever Lance.

I know NOTHING can ever replace what you lost, your perfect baby girl, but at least some are being held accountable for their actions/lack of.

The people responsible should be thrown in debtors' prison until the last penny is paid. What's going to happen is, these DHS bureaucrats will get a winking reprimand, and you and I will foot the bill for their failure to excute the responsibilities of their job. They really need to bring back debtors' prisons.

I think I would have preferred that all those responsible for not doing their JOBS, lose those jobs. THAT would have been more fair justice than the money.

DHS made mistakes? GASP!!! Hard to believe they continue to tell us they know what they're doing.(Heavy on the sarcasm.)

DHS can't do it's job so they have out-sourced to a company that is just as incompetent and the children are paying the price. It's time to dismantle DHS, starting at the top, then completely revamp it. It's not working as it is, so something needs to be done. They keep kids out of their homes that should be returned, and return kids that wind up getting killed by their families. Gee, what's wrong with this picture?

Each one of them should also have to face this child's father and give a sincere apology for their failings. It also wouldn't hurt to have them do a little time for child endangerment, because that's exactly what they did.

I agree with you on this, but we know neither of these two things would ever happen. Personally I believe that the former Judge...Mr. Craig Key should be disbarred and he should be sitting in prison next to Porter. He made his decision to return this child to her mother before the hearing ever took place, which means BEFORE he heard the evidence. He told not only Raye Dawn Smith but also the ADA that he'd made a mistake and was returning Kelsey to her mother's home. Less than 4 mo. later, little Kelsey was murdered in that home. Let's not forget there was confirmed abuse to Kelsey by DHS listing her mother, Raye Dawn Porter Smith as the perpetrator of the abuse to Kelsey. Key had the power to save Kelsey's life and didn't. Wonder if he got to this decision from another talk with his "favorite cow"?

And now Raye Dawn Smith and her Lawyer are going after half that money that was awarded to Lance...You see, if you haven't actually been convicted of Murder in Oklahoma, the have the right to go infront of a judge with this insane idea...Here is a link to a petition that is asking that Raye Dawn not profit off her daughters death in which she clearly enabled..

I can't believe that she is going to do this, after she publically stated that NO one should profit off Kelsey's death, but now cause she has legal fee's up the wazoo, now its okay to profit...Just proves she is more guilty to me, by going after this money...

Like most abusers, our father recognized that he no longer had direct access to our mother after the divorce, but he DID have access to us kids.
