Fire Burns Raton's El Portal Hotel

The historic El Portal Hotel has suffered serious damage in a fire that started near midnight last night. Fire crews are still dousing the hotel with water at 8:30 a.m.
No one was hurt in the fire, according to a resident.
For those not familiar with the El Portal, it is a two-three story building that takes up a half-block of downtown Raton. In addition to the long-term and overnight residents, the El Portal is home to a new radio station and the Park Avenue Cafe.
The entire north end of the building, directly across from Cimino Ford, appears to be completely destroyed (this area of the Hotel has been vacant for many years). And the apartments on the west side of the Hotel, adjacent to Third Street, also appear to be entirely burned.

I'd like to express my sympathies to those who have lost their apartments and belongings. I understand that approximately 25 people were put up in local motels courtesy of the El Portal owner, and their stays are being extended by the Red Cross. Decent rentals are few and far between in Raton, but hopefully these individuals and families can find more permanent housing quickly.
Also, my sincere sympathy to the workers who depend on the El Portal and attached businesses.
Again, it's very lucky that no one was injured. Stuff can be replaced. Apartments and jobs come and go. But losing a loved one in a fire would be a horrible experience that would linger a lifetime.

I am the owner of that "unlicensed pirate radio station" in Raton, NM. If you closely investigate and thoroughly reexamine your "facts" through the FCC's website, www.fcc.gov , you would clearly see KHOD @ 105.3FM is unmistakenly granted federal authority to construct its broadcast facility in Northeastern New Mexico, effective June 28, 2006. Please get your info correct before you stupidly make false assumptions about others or their business, and therefore make yourselves look quite foolish in the process. You just never know whom may likely review a Topix electronic post full of fictional fabrications in the future and then have to address the issue to set the record straight.

In this Notice of Apparent Liability for Forfeiture ("NAL"), we find
that Hodson Broadcasting ("Hodson"), permittee of station KHOD(FM), in
Des Moines, New Mexico, apparently willfully and repeatedly violated
Section 73.1620 of the Commission's Rules ("Rules") for operating
KHOD(FM) at variance from its authorization. We conclude, pursuant to
Section 503(b) of the Communications Act of 1934, as amended ("Act"),
that Hodson is apparently liable for a forfeiture in the amount of ten
thousand dollars ($10,000).
On June 25, 2008, the Denver agent inspected KHOD(FM) and observed
that the station continued to operate from the Raton, New Mexico,
studio/transmitter site. The inspection revealed that KHOD(FM) had no
special temporary authorization ("STA")/waiver to operate on-air, or
to operate from its current location, no public inspection file, and
no operating emergency alert system ("EAS") equipment. The agent
interviewed the owner of Hodson Broadcasting. Hodson acknowledged that
the KHOD(FM) signal in Raton, New Mexico, does not reach the KHOD(FM)
construction permit's community of license of Des Moines, New Mexico.
KHOD has a construction and broadcast permit all right, but NOT in Raton, and NOT from the roof of the El Portal Hotel. Apparently Hodson is the one who doesn't understand their own permit.
Additionally, their construction permit expires in June 2009. Have they even started construction of their tower in Des Moines yet? Just curious...

I'm calling you out, "Richard Hodson". Please provide the exact FCC link to KHOD's license to broadcast at 105.3 FM from the top of the El Portal Hotel in Raton, New Mexico.

i think mr hodson oversteped his permit. the different violations add up to more than $30,000.00 but it seems the fine assesed are for the first Major violation and they do not stack them up.
as a side note the fines for continued violation of broadcasting on an unlicensed station can reach $75,000.00 .
seems to me like a mouse standing on a rock shaking his fist in defiance at an eagle.but that is just my opinion.
something is not right about mr. Hodson!

I understand my broadcast construction permit indeed...and I certainly understand that since I am the authorized FCC permittee, I decide where the radio station is built, and when the community of license, transmitter coordinates, or other pertinent numbers and info are modified on my FM construction authority. KHOD is on target to meet its modified buildout deadline in June and will be returning to air shortly, continuing to spin great Classic Top 40 tunes, commercial free and "twenty-one in a row"...
First off, a Notice of APPARENT Liability (NAL) is the government's first course of action when they feel a rule or regulation has possibly been violated, similiar to someone initially getting an indictment in any standard civil or criminal case. Given this legal and procedural enlightenment, let's firmly realize not every accused citizen or entity arrested and/or charged is actually convicted of said alleged crime(s), nor remotely guilty sometimes even to begin with. Their day in court normally resolves such matters, but thanks for prejudging anyway. Since you are obviously on the outside of the radio station looking in, plus have incorrectly assumed that what you read online or in the Raton Range as ironclad gospel (when have you ever known the government or the local press to always be 100% accurate in their reporting?), you probably never have even considered Hodson Broadcasting's position in this mistaken matter. You claim I don't understand my CP, but contrare I do, otherwise I wouldn't already have the initial authority to build my broadcast facility, nor be on the air for as long as I have been. Please ponder that a moment. The sole reason KHOD is currently off-air is because Raton Utility shut the power off at the transformer after the El Portal fire last Wednesday evening. Once electrical safety certification for our part of the building is secured, we will immediately return to air. And if not in conjunction with the El Portal, then relocating will commence at another location in Raton, and KHOD will again resume its broadcast mission in a timely fashion.
Wait a minute...I don't have to justify what I'm doing behind the scenes to make this station continuously groove. However, thanks for sharing what you mistakenly thought was completely accurate info on KHOD, obviously just because it was issued by the federal government, or perhaps you feel you know something more about my own company than I do.
Hopefully that answers those so critical of "Raton's Radio Revolution"...stay tuned!

from what i found on the website under violations it seem that you may be mistaken -they sometimes lower or drop fines for inability to pay full amount or any amount. i looked thru several years worth on the website-NOT a ONE was Lowered or done away with because the agent or fcc did not know their own rules.i saw a lot of different alibis and different interpreations offered by the entity fined but no reversals . i also cannot find where any new applications -waivers or other engineering has been accepted or filed.
I will bet that your fine will stand or only be lowered if you are unable to pay it.
i also have found this to be at least in last 8 or ten years the only violation of this type .not the unauthorized operation but the siting of a transmitter 30 or more miles from where it is supposed to be.there are some very huge fines for moving a antenna and not having approval.
one thing i found interesting was the eas system i thought it a must have type of system to protect the listeners in an emergency.do you not have one if so why?

if not what experience have you had in court?
have you ever been in trouble with the law?

If you would do alittle RESEARCH you will find that the FCC always gives licensee's the opportunity to state their case before they hit them with a fine. 9 times out of 10 the FCC will reduce fines. Also the FCC visited KHOD last June. The way you make it sound, it just happened. Here is a question, Have you ever been a Licensee or ever been through the FCC Auction? Or even on the Executive board of a full power Broadcast facility? If not you need to SHUT THE HELL UP!!!!!!!!!!

If not,what experience do you have with the FCC court proceedings?
Have you ever been in trouble with the FCC?

actually before i retired i worked in preping stations for sale(or aquistion) for both buyers and sellers. this prep work included checking for defiencies in fcc matters.this included due dilegence in making sure the buyer would not end up paying previous owners fines etc.making sure the public file was legit and up to date and logging was current. evaluating equipment and all titles clear.it also required me to do background work on principles .That i saw more than a few people that were"Hinky" made me ask you if you had ever been in trouble.Sorry but something smells funny.
I also read your bio etc from fcc.files etc nothing i saw shows management experience.

oh dan the man -I did bother to listen to the Pirate one day while i was in Raton-that is simply that i also know who you are and you have been a part time dj at krtn not exactly someone
with a lot of REAL KNOWLEDGE.Though i do commend you in trying to defend either an employer or possible employer.
I think Mr.Hodson has something to hide.

What, you have no job? You seem to have all the time in the world to BITCH about something that you think you know about. Have you been to Raton, say in Feb? Get a life and have more concerns about the people who were displaced from the fire.
