City sues ARPA, claiming breach of contract, misrepresentation
Raton city officials are willing to discuss further with the Arkansas River Power Authority the city's concerns and frustration about ARPA's Lamar Repowering Project, but that willingness to talk did not stop the city from filing a federal lawsuit against ARPA last week seeking to limit Raton's financial liability regarding the project the city has opposed after initially - and reluctantly - approving it with a smaller budget than the $110 million cost the project has currently reached.
Through the Albuquerque law firm hired to represent it in this matter, the city filed its lawsuit last Wednesday, Jan. 9 in U.S. District Court in Albuquerque. In a statement issued late Monday afternoon, ARPA promised to "vigorously defend" against the city's complaint. Also, the ARPA board at a special meeting Friday authorized its attorney to file a countersuit against Raton. Read more
