Ex-sergeant, outed as lesbian, wants to re-enlist

A female sergeant who was discharged from the Air Force last year after South Dakota police reported her marriage to a woman wants to re-enlist now that the ban on gays and lesbians serving openly in uniform has been lifted.

I think she should sue the police ! They had NO LEGAL RIGHT to inform the military as to her marital status, nor sexual orientation.

Police disclosure of sexual orientation to the military has been a common reason for dismissal. No doubt, there's a high degree of homophobia on thE part of police. It also probably reflects some police's predilection to punish a "perp" every way they can. Anyway, it's over. Thank Obama for a well-orchestrated repeal of a bad law.

She still could probably sue the local Police Department and as long as she remains fit for service and her evals were good.....she'll probably be able to re-enlist.

DADT as bad as a policy law as it was.....was NEVER meant to be used by Third parties. It was designed to allow Gays and Lesbians to serve without disclosure of their sexual orientation. The government could not ask and the Gay or Lesbian need not tell......but most discharged were done so under a third party disclosure like this woman was......and that was NEVER the intent.

She should sue the Military and get back-pay and time in my opinion, though that likely won't happen.

Good point. There was a third leg of DADT that's rarely mentioned. The full name of the act was Don't Ask, Don't Tell, Don't Pursue. But the military often pursued third party leads and servicemembers were powerless t defend themselves without violating the "don't tell" portion of the act.
This servicemember wouldn't have a legal cause of action, however. The police department reported a public record to her employer. She had no reasonable expectation of privacy. Police records are public records, which is why newspapers would have been free to report the same information.
