Accompanied by her attorney, Danny Moore, Melissa Jo "Missy" Austin Baggett, 38, again appeared before Associate Circuit Judge John Bloodworth for the continuation of her preliminary hearing.

After hearing testimony from two additional witnesses, Bloodworth, who heard from three state witnesses in May, ordered Baggett to stand trial on murder charges.

Bloodworth ordered Baggett to appear Aug. 21 before Presiding Circuit Judge Michael Pritchett for arraignment.

Everyone has a past so enough about the austins. My maiden name is austin. Would you like it if people was talking about your family???? Only God knows about that night..... you people need to.get a life and stay out of it. Glad you guys get a kick out of talking about my family. It would appear the prosecution's cases are getting stronger with each testimony from the hearings. With Carla D joining the chorus along with Randal and others, the singing is getting louder and stronger. And since these latter two were reportedly present at the crime scene but not charged, it kind of makes a person wonder who else may decide to join this band of singers.
As the charges are elevated, so is the potential for a sentence of imprisonment for life without eligibility for parole or probation. The thought of the possibility of never seeing the outside of prison just may have a more dramatic impact on who thinks they can sing.
Isn't Carla D the ex wife of Johnny? The pissed off one left for a 23 year old ... don't that make her a hostile witness? And if she was there like they claim Missy was , why isn't she being charged for the same thing ? Seems like it might be a little bit of revenge coming out of her mouth.. The way i see it ,, she was either there and should be charged equally or she isn't nothing but a hear say witness getting back at the man who left her ...

So you say “Everyone has a past”? That may be a true statement, but very few have a past that includes murder of one of their own family members. The Austin Family Murder Gang will likely be in the news and talked about for a long time so get accustomed to it. It won't matter whether you or anyone else likes it or not, it will continue. In reference to your dim-witted statement that “Only God knows about that night.....”, anyone that has followed the case at all knows better than that. There has been considerable sworn witness testimony in court that places at least six people at the scene on the night/morning the murder was committed. That fact pretty well nullifies your claim that only God knows what happened. It is somewhat satirical that you use a phrase that includes “get a life”. All evidence disclosed so far indicates members of your family appear to be more in to TAKING a life. Clearly some members of your family are much more in need of prayers than those posting on this thread so you may want to direct your prayers for them.

You know very well she is John's ex-wife. Regardless of the possibility she may be "pissed off" or not, if she is credible and believed by the jury her testimony will likely have substantial weight influencing the eventual guilty verdicts.

Perhaps she (Carla) should have been charged, however the fact remains that she is NOT charged and Missy (along with John, Henry, & Tracy) is charged. Multiple witnesses' testimony has already placed her at the scene. To presume Carla's testimony would be interpreted as “hear say” amounts to nothing more than wishful thinking.

Your reference to “hostile witness” demonstrates your misunderstanding of what a hostile witness is. Every witness could be termed a “hostile witness” to the opposing side in every trial. I would presume what you’re referring to is when a witness called by one party gives testimony that adversely affects that party’s case. Then the judge may declare them a “hostile witness” even though they were called by that party. That probably won’t diminish the impact of her testimony and may even make it more potent for the prosecution.

It is time to face a few facts. The evidence presented so far would tend to support guilty verdicts. These individuals will very likely receive extensive prison sentences when convicted. The sentences will be even more harsh due to numerous aggravating circumstances. For one, it smacks of being a conspiracy and stinks of premeditation. That could result in conviction of first degree murder for some. That could mean a sentence of life without parole…..meaning they’d never experience another day of freedom and ultimately die in prison. Even if the guilty verdicts were for a lesser offense such as second degree murder or even voluntary manslaughter, conventional thinking members of the jury will question why not one came forward in the dozen years after the crime. Where could you get testimony to dispute that?

Tracy Rea will be in court in about an hour and a half. Wonder what will happen. In the paper Melissa lawyer stated "so rea could have beat her to death" sounds to me like they are going to attempt to put it all off on Tracy. Who is honestly going to believe that the rest of them had nothing to do with it and if they didnt want her dead then why wouldnt they have stopped her? Also Carla Ds testimony seemed shady. She's the only person that never heard john say anything at all that night? Randall and rea both stated he had Said things and guelledg also said he was yelling at the bar. She ought to be charged also it sound like to me.

There are a lot of different possibilities that people can conjecture and speculate. Here’s a wild one for consideration. What if Tracy Lynn is ready, willing, and able to provide evidence that the other three planned the murder? What if she can help the state prove it was premeditated and therefore first degree murder? Imagine the positive publicity for prosecutors that successfully prosecuted the crime as first degree murder rather than run of the mill old second degree stuff. Now throw in the fact she’s the only one NOT presently facing a 1st degree murder charge (could still change today)and the possibilities boggle the mind. What if she enters a guilty plea? What if she enters an Alford plea? Could she escape with a slap on the wrist? The world may get to know more in about an hour so I suppose we all need to resign ourselves to the wait……

Me too.....
I believe that would enhance and increase the pressure on the others and make the prosecution's cases even more compelling. But more importantly it might have the affect of shortening the time for all these cases to be concluded. There are just too many innocent people being stressed and hurt by this whole ordeal. The sooner the two young daughters can have some closure the better for all concerned.

I agree. This has been very stressful and heart wrenching on Carlas family. My thoughts and prayers go out to her daughters and her father. Also to all her family and friends!

your a bastard because GOD does know what happened that night. I think that if my family is found guilty then johnnys ex wife carla should be found guilty also. Let the judge decide what to do,not you. Yes we have all read the news papers and saw the news but thats all we know.....like i said, let the courts and God handle this.

No....I'm not a bastard and I don't come from a family that kills their own relatives either. Perhaps God does know what happened that night. At this point that doesn’t matter much because He will not testify in court. But the others also know and will testify. That will very likely be enough to get four of them convicted of murder. What you "think" about whether Johnny's ex, Carla should be found guilty doesn't make a bit of difference. She won't be found guilty because she's not charged. In case you've been in a coma, the newspapers are reporting the transcripts from the court hearings so we all know pretty much the story. Much of the testimony is coming from your family members. I suppose you can take pride in the fact that they’re turning on each other. You’re right about one thing. The courts will take care of it and the outcome probably won’t be too pleasing to you. However, it may make others very happy and provide a degree of closure for some. Your best avenue is to get some counseling and prepare for the worst since the evidence appears to leaning toward convictions for murder.
