3) Administrative Vehicle Forfeiture
Minnesota’s DWI law provides for vehicle
forfeiture for a designated license revocation or
designated offense, which is typically the third
DWI violation within a ten-year period, though
with one or more aggravating factors, a person’s
second-time or even first-time violation might
qualify as well.

This happens more than you know it just doesn't make front page news. With the reviews going on in the capitol over the forfeiture laws right now, everyone should be outraged that the police are auctioning this off for the profit they can make from it. It's crazy enough that he was booked for a DWI, but then to make money off it is just ludicrous. I could see the court saying he should auction it off and donate the money to charity which is exactly what the police dept should be doing. There should be a law against the police using Ebay for this as well. MN is truly a police state now.

I agree, it is insane he was charged with DWI if you agree DWI is a crime because a drunk individual is in the control of a multi-ton vehicle that can do a lot of damage and can cause death to others. Now bring up the picture of the chair. Seriously, how stupid is this! What's next? DWI while in a power wheelchair? DWI while on a powered razor scooter? More like proctological exam MN as I'm sure the owner of the chair feels this is happening to him, except that exam would be far kinder and gentler.

This is a good example of theft by government!

Infractions should have a set fine and that is what people pay.

I know a guy who restored an old car working all his spare time to make it perfect. He got caught at .09 and they took his car and sold it.

I know others with lots of money who loose a car for DWI and could care less because they have millions.

IMHO, This is a CLEAR CASE of rotten government!

In fact the most appropriate fine would be to use a persons net worth and income level to levy a fine. IF this were done the rich would pay a lot more for the same infraction and penalties would be progressive NOT regressive.

I know it happens all the time. I was mearly pointing the actual law out to Laura who said it doesn't and the person who agreed with her (and disagreed with me).
