Also, I might add that if they added the little heart accent on the end of the choker chains, that is Sabika's trademark also.

I am not for Sabika over the other companies or vice versa. I am just saying always be careful so as to not infringe upon anyone elses copyright.

And as for the people here that question others christianity, if they are wrong for what they did then God Himself will judge. It is not up to you or I.

When it comes right down to it neither one of them will be worth a lot later it's COSTUME JEWELRY so if I would rather pay less for the Same look well that's up to me. That's my right I guess until Obama takes that too.lol

I'm really surprised that it took this many posts to blame Obama. These ladies got the idea from looking at Sabika. God did not send them a message and tell them to make jewelry. They should not say they are standing behind God. There are alot of skeletons in those closets. Maybe instead of praying for a victory in court they should be praying for forgiveness in the church. God bless all the fools.

I didn't mean to insinuate that Sabika had a copyright on the little heart at the end of chains on the chokers. I meant that Sakika puts those on there so you will know it is their product. Yes, you are right that these hearts are sold on the internet and are on jewelry sold in some stores. I still stand by my post that if these ladies were using Sabika catalogs and such to promote their items, then they are guilty of copyright infringement. If I were going to make jewelry and sell it, I would not make one identical to a company that had copyrights on it's materials. If they used this technique to promote their line, then they were wrong. I will continue to buy both Sabika and the knock-offs. This is my right and think what you may, to me it is not different than going to Belk or JCP to buy costume jewelry. It is all the same and none will be worth anything in the future because of mass production. The only value might be sentimental. I will still let the courts decide who is right and who is wrong. Peace to you all.

Well I think its silly. I make my own jewelry and it looks exactly like the girls in trouble for it. I actually took my sabika apart. Its the same thing, the same crytslas. Metal casing may be a litte heavier and there is a little engraving on back. Other than than that, no difference. Sabika is just pissed and I think its funny. I will never recommend them to anyone nor will I ever purchase anything from Sabika for coming down on these girls. The only thing I would actually like to ask is about the very end of cup chain. I order from a website not stateside but I would like to do my ends like Goshen but not sure to do it by hand or if the end comes that way on the cup chain itself

The makers of Goshen and Sabika have reached an agreement. Sabika is shutting down. Goshen will continue to operate under the name GoFauxShenIka.

GOSHEN JEWELRY DID COPY SOME PIECES EXACTLY FROM SABIKA. All you have to do is pull sabika spring book and compare it to Goshen fb page.......unless those pics have been removed too ..if they came up with their own ideas go small business but copy someone else's and face the consequences. I also know for a fact if you go to one of their shows u can ask for whstever combination you want they'll do it ....even if it is just like a sabika piece....for those of u who are bad mouthing sabika how bout you come up with your own business idea thats made you a lot of $ then have someone come in and undercut you for their financial gain.....taking $ from local consultants these god fearing women better have a great lawyer.
Presumption of innocence

I find most of these comments fascinating. The rush to the assumption of guilt is far too quick and should be met with caution.

Our entire judicial system does, and should, operate on the presumption of innocence (innocent until "proven" guilty). However, most of you who post are really quick to pass judgment before completely knowing the all of the facts. One has to wonder if this is how you operate in your life; how you treat your friends, your spouse, and your children. Are you a “quick to judge” person?

I dare say, should any of you find yourself in the midst of a criminal or civil suit; you would WANT the presumption of innocence. But yet, you're not willing to give that here. You're set on hammering the gavel, pronouncing a verdict of guilt and thus moving on to sentencing.

Just stop.....take a breath and ask yourself what you I want in life from others. What are your expectations of others towards you?

Maybe, you should reserve your judgment until innocence trumps guilt or vice versa.

Just something to think about before you allow your personal emotions to be verbalized in writing.

Here is a list of Sabika's copyrighted pieces. There are two pages and you have to click "next".

http://cocatalog.loc.gov/cgi-bin/Pwebrecon.cg...

Interesting note: Some of these pieces were only copyrighted this past fall. If someone used similar designs to those previous to that, would it even count? Who would REALLY own the rights? The person who created it first or whoever got the copyright approved first?

Here is a list of Sabika's trademarks. There might be more, but I didn't find them.

http://cocatalog.loc.gov/cgi-bin/Pwebrecon.cg...

Note: The pink heart bead is not listed as either copyright protected or as a trademark. I guess, it could technically still be considered one but that seems iffy, considering how common pink heart beads like that are. As I said before, I don't. know if it even matters since I haven't seen any crafter's pieces with that on them, and I've never seen anyone use a Sabika catalog when selling, either. It doesn't mean that nobody did, but it wasn't something that I saw done.

This is definitely not cut and dry, and with the relatively recent copyrighting of quite a few pieces, the claims of a set-up seem even more convincing to me, personally.

Sorry, I copied the trademark link incorrectly and it didn't take I guess. Here is the link to Sabika's registered trademarks.

There's no "good luck to u". I need know luck here. I have nothing to do with either companies. However, I think that there is a bigger issue where YOU are concerned.

What has happened to you in your past that would cause you to immediately conclude guilt before viewing the facts presented by all sides?

I think the point here is not whether two businesses are right or work in their principles of operation. I think it goes deeper in to the fabric of who YOU are and YOUR need to pronounce immediate guilt.

Of course, you're going to respond with a comment to try and defend your position. But, the one thing that you will not admit on this thread, is that my posting DID cause you to think about who you are as a person?

But, then again, maybe you didn't. Maybe you already KNOW who you really are as a person; "I would be shaking in my jewels if I knew what could happen......."

Courage is not the lack of fear but the ability to face it."

Perhaps you should seek legal counsel before going in a public forum making false allegations. The last time I checked, slander and libel are both crimes punishable by law and can carry some severe consequences. All posts from this forum can be identified as the individual making the type of statements you are making. The reason I included slander is because you have made these same statements verbally to others. Word travels fast and soon these ladies involved and their attorneys will know it was you.
In addition, let me educate you on an LLC. With this type of business, individuals rarely stand a chance of losing personal possessions because they're protected by the LLC. Once again, you and your assumptions are incorrect. I hope this company wins this suit and goes after you for defamation of character, slander, and libel.
As for dragging a church into it, shame on you! This is yet more proof of your true character.

Once again, another person assuming they know the truth. Did you see the dates these ladies put their pictures on their Facebook or the Internet versus the date the book was released. Until you have, you too may be guilty of slander and libel. I'm so excited to see the outcome of this suit for these ladies. I hope the makers of this type of jewelry take over the jewelry market in this area just because of people like you!!!

I never even bought from these particular women, but I'm pretty excited to see the outcome, too! It's very brave of them to get an attorney and stand up to this big company rather than backing down! I hope that they win and score one for WV and the little guy!
