Assistant Attorney General Harold Deering is assigned to the Brand Board to provide legal guidance. At a point in time Deering advised the Brand Board –
“…The legislator delegated the power given it by the people through the Constitution to the Brand Board……Reference to the Constitution which includes the Bill of Rights brings you to article 18 titled “Equal privileges or immunities,” Quote,“No law shall be passed granting to any citizen, class of citizens or corporation, privileges or immunities which upon the same terms shall not equally belong to all Citizens or corporations.”
The provision of the States constitution is of interest that ownership and title to cattle in half the state by a mark registered by the State and documents issued by an inspector. This system of ownership is not present in 45 East River counties and the thousands of brand owners East of the River are not receiving the full protection they pay for.
Stock men state wide are working with the legislature to help the Brand Board meet its obligations to provide for state wide registration of brands and state wide inspection and insure all brand owners will receive the protection they pay for administered by the Brand Board.
