A Dutchess County jury Thursday convicted 21-year-old Cheryl Santiago of second-degree murder for suffocating her young stepdaughter in her Town of Wappinger apartment last fall.

There's something that did not come out in this trial. Like, why didn't the dad try to resusitate the child if Cheryl did not. So, if they found Cheryl guilty of not tryng to perform CPR, why wouldn't the dad also be guilty? Perhaps he did try, but I don't recall reading that statement.
Additionally, it is my understanding from someone fairly close to the case, that the child had asthma problems and perhaps other medical issues that could have very well added to her death. And that perhaps one or both of her parents may have been in denial of this issue.
I think the jurors got this all wrong. I am not saying that Cheryl wasn't negligent, but I just don't feel that Cheryl maliciously caused the death of Justice. Nor do I feel there was enough evidence compelling enough to prove she did do something intentionally. She has been convicted, in my mind. of what she did not do, not what she did (albeit circumstantial facts to make it look a bit hazy on what really happened). If we could all just turn back time. But we cannot. Justice will forever be in heaven.
But if she gets the 25 to life sentence that could very well be charged to her, that itself is going too far. That type of sentence is for these cold blooded murderers who kill for fun. Not for this type of situation where it is not what she did, but what she didn't do.
I hope her lawyer does file an appeal and that it is accepted and that he finds some type of evidence that will clear Cheryl , or at the very least reduce her charges.
On the other hand, if the prosecution can dig up some concrete evidence to prove she did it beyond a shadow of a doubt, then yes, let her serve a life sentence or the 25 years. But I just don't feel she did it,#1, and #2, if it was an accident, she should get the lesser charge.
May baby Justice rest in peace, but may Justice be served by applying the appropriate charge to Cheryl. May God Bless Both both families.

FYI her father Santos works at night so Cheryl was the only person with the baby.

Your above statement is pure ignorance! The woman confessed to murdering the child! It took her about six minutes to smoother this child to death. That's cold blooded the last time I checked. She deserves death and it's too bad NY can't execute her for killing this beautiful baby. All because she was jealous that the father loved his daughter. That should be applauded. And there is no charge for not resesitating someone, how dumb can one be! The child had been dead for hours. She was obviously that way when her father found her. You can't minimize murder, especially when an adult smoothers an innocent child.
