A Portage man accused of killing his would-be bride told police he was handling a .357-caliber revolver, putting a bullet in and out of the gun, when it went off unintentionally, shooting his fiancee in the head.
Jason Hardt, 25, is free on a $25,000 signature bond after appearing in court Wednesday on a charge of homicide by intoxicated use of a weapon with a domestic-abuse enhancer.
Hardt told authorities he drank four or five beers and had about six shots of whiskey liqueur before picking up the revolver at his Cameron Heights Apartment unit, 1116 W. Wisconsin St. His fiancee, Rebecca Weisenberger, 25, who lived with him, was at the apartment when Hardt's gun went off early Sunday.
Authorities responding to the 911 call shortly after 1:30 a.m. Sunday discovered Weisenberger in the living room of the apartment, lying in a pool of blood with the revolver about five feet away from her body, according to a criminal complaint.
An autopsy report indicated that Weisenberger died from a close-range penetrating gunshot wound to her head, the complaint stated.
The couple, after returning from a night out drinking, sat facing each other across a bar in the apartment, drinking and playing cards, when Hardt brought out a revolver he keeps behind the bar, the complaint stated. The revolver had been unloaded, but Hardt told police he put one bullet in and out of the gun several times. At one point, he put the gun down on the bar, then picked it up again. The gun discharged when he picked it up, hitting Weisenberger in the face, according to the complaint.
Hardt, after picking Weisenberger up and cradling her, went to get help at an adjacent apartment.
Portage Police Detective Lt. Mark Hahn said investigators were told that the hammer on the revolver was cocked back when Hardt picked it up, making it more likely that the gun could discharge unintentionally.
"We have not found anything in our investigation that would indicate that this was intentional," Hahn said.
Hardt owned the gun, which was possibly purchased about seven years ago, Hahn said.
The results of a blood-alcohol test to determine Hardt's level of intoxication are not yet known, the complaint stated.
Hardt's defense attorney, Christopher T. Van Wagner, of Madison, said that Hardt has no prior criminal history. He called the shooting "accidental" and said Hardt was receiving the full support of his family.
Van Wagner said Hardt did not object to bond conditions forbidding use of alcohol or possession of a firearm.
"He doesn't want to see either of those again," Van Wagner said.
Hardt served five years in the Army National Guard, including 2 1/2 years in Kuwait and Qatar, Van Wagner said.
Judge James Miller called the incident a "very tragic matter."
Van Wagner argued for a signature bond because, he said, Hardt is a lifelong resident of the city with family in the area and wasn't a flight risk.
Columbia County District Attorney Jane Kohlwey requested a "substantial" cash bond, calling it a "very, very serious crime."
Miller agreed with Van Wagner, saying Hardt was minimal danger to the community and was not a flight risk. He ordered that Hardt must live with his mother in Portage.
Hardt faces up to 15 years in prison and fines of $100,000 if he is found guilty of the charge.
He is scheduled for a pre-trial conference Jan. 2.

I don't think she did it herself.. he did it messing around with a gun.. its not like they were fighting or anything like that.. i live down the street its just unreal how horrible this is. He feels horrible that he killed his fiance... But her father also said that they were very much in love and doesn't think he did this unpurpose.... guns and alcohol don't mix. I mean the guy was honest about it and told the cops he was drinking and not just a ittle.. so he still needs to pay for the crime... what is the world coming to these days...

I could use this moment to argue for tighter gun laws. But a couple of yahoos would start filling this post up with misquoted jargon from the Second Amendment, followed by another person direly interested in lecturing me about people killing people and the vast majority of gun owners are responsible, yah dah, yah dah, yah dah.
So, instead of going through all that nonsense, I'm going to say this:
I wish you would have lived a longer life even though I did not know you. I wish your smile could be felt by those who loved and loathed you. Some time things get out of hand, as often as they don't. Some times we handle it well, even though we think we won't. You gave us the worst and best of you, the gloomy and brighter side too. Though we will be able to move on and forgive this incident, your contribution to us all while you lasted was never misspent. I wish your soul and spirit a pleasant fairwell, another human victim whose life will be greatly missed.

He would never hurt anyone intentionally, ever! now he has to live with this his whole life based on one moment. How can you say anything u evil people? Only God can judge him and he has to deal with this not you. shame on u all for your shitty lies and thoughts. He is a great person just happened to make a very poor decision.
