Hello Sandy. Do you have anymore news about a class action suit? I moved forward on my own and will have my pool completed in a couple of weeks. Then I need to focus on suing Harbor Bay to recover some or all of my money. It cost me a bundle to do this on my own and I do not have a lot of money. It really hurt me to lose that money and it will take a long time to financially recover. I have also not had a response from the news reporter who interviewed me from WPBF. Is seems like this is quietly going away.

Please contact Terri Parker at WPBF and tell her your story. Two of us were interviewed and story has yet to air. I think the more people that contact her the better chance the story will run.

Trust me when I tell you...you're in a Better position than most of us. I wish I was in your boat!! Although I understand still upsetting! They should not get away with this!!

South Florida Custom Pools. They did a beautiful job and although the pricing was higher for me than having him do the entire pool from the beginning, it was fair. They came when they said they were coming and the entire process moved along well. Ask for Rod.

Class action lawsuit is stupid. Suppose the seize $100 k of his assets. The attorneys will get half and leave you guys to equally split the rest. The guy who lost $40 k gets the same payout as the guy who lost $10 k.
Be the first guy to sue using your own attorney and hurry up. Class actions only benefit the attorneys.

I thank my lucky stars all I had was service with HB Pools.
I will tell you I had heard that another company had taken over their unfinished contracts.
However, There is a company out there that says they are HB....No Way Jose !! They have their route book and trucks with HB Phone #. Watch out they are probably billing under the same name.I am going to report this to the BBB, Consumer Credit Protection and may go to the State's Attorney BEWARE

I typed up a well thought out response to cover everyones concerns, but sent it into cyberspace. This is not my realm.

I would like to again thank J Moran for allowing us to continue our contract.

I know everyone involved has been misled and are frustrated. We too are struggling to do the best we can under the circumstances. It is only myself and Rick doing the work these days.

As a small business goes, we would be considered a "micro" business. We have been "put under the gun" so to speak as the effected homeowners have found several companies to complete the projects. Which in turn are coming to ready at the same time.

All we can do is ask for patience and know that we are completing these at the best of our abilities. Currently we are constructing Mr. Brantmans' enclosure, then one of our own sales, then Mr. Prickett, then another of our own and then Mr. Larsen as of todays schedule.

We can only schedule on a "first-topped" basis at this point. Jobs that were scheduled for pre-June and July are now melded with those scheduled for August and September.

The list goes on, Napier, Gershkovic, Sherry, Ranew....and I'm sure there are a few more I can't bring to mind at this moment. This is what our small company is now trying to do right by others.

PORT ST. LUCIE Heather Gershkovich couldn't wait to see her kids swimming this summer in the pool she paid Harbor Bay Pools $27,100 to install in her backyard. She's still waiting.

The company closed in late June, prompting Martin County to revoke its license and the Sheriff's Office to investigate two complaints. The Better Business Bureau has 12 complaints against the company, President Kevin Martz and Vice President Derek Proffitt, according to spokesman Mike Galvin.

"You save all your money to do something for your family and then it turns out like this," Gershkovich said. "I'm disappointed, frustrated; there were nights when I cried myself to sleep. It's a heartache. This was to be something exciting for my kids and it turned out to be a big money pit."

Roger Prickett, also of Port St. Lucie, paid another company $11,000 on top of the $20,510 he paid Harbor Bay after the latter left him with dirt piles and a cistern.

"We had frogs, and I even took a picture of a snake. A blue heron flew in to eat the tadpoles," he said. "Anger is not a strong enough word to describe how I feel. It's very sickening to me that he did not keep his promise."

Martz, who opened in 1999, cited financial difficulties and said he hopes to make good on contracts.

"After three years of a bad economy and with the type of custom pool we do, we couldn't keep afloat. We put everything back into the business to keep it going. We should have stopped a few years ago but we didn't, we tried to keep going," he said. "We had 87 employees and their families and their health benefits to think about too."

Martz estimated he is "about $50,000 from being able to get back in business."

In an email to customers, Martz said, "A chain reaction of events has taken place over the last several weeks that has left me without the resources necessary to complete your projects as of now. While I still have every desire and intention to complete your projects, it must be done at the mercy of impending funds from any possible sale of assets."

Some of his problems resulted from foreclosure on homes where he was building pools, and from homebuilders and others who didn't pay, he said. Some came from lawsuits he called "frivolous," and some from old debts.

Clients have complained about a lack of communication from Martz, who said he is working out of a home office. He uses a mailbox at the UPS Store on St. Lucie West Boulevard and has left his business phone on and his website online, he said.

If someone, or everyone, does not continue to put pressure on Kevin and Derek through the states attorney or local law enforcement they will do this again and everyone will lose. Do NOT let them get away with Stealing your trust and monies.

If that is true beware. I did some checking and Advantage Pools is owned by Roddy Brown. There is another company Florida Pool Plastering that is also owned by Roddy Brown and Robert Grabowski, who is the owner of Flamingo Pools. I heard some bad things about Flamingo also. Birds of a Feather.

John you are extremely misinformed. I work at A&G and contracted and completed many of these disasters. We would never hire Kevin and I suggest you remove that post about him working for us.

It's ridiculous. He's definitely not working for A&G, I'm glad that Jason responded to that-as A&G completed my pool. I'd love to see him pay back every penny he owes, but it will never happen. And, after Adirondack completed the screen for me, I had an issue with a leak--I've been leaving messages for them since DECEMBER and have NOT received a call back. I can't stand this anymore. I'm in an incredibly huge financial hole and it's getting more and more difficult for my husband and I to get out of it.:(
