I had a lot of trouble with Harbor Bay Pools and ended my contract with them. Now have to complete my pool on my own. I am interested to know how many other people have experienced problems with Harbor Bay Pools. I would like to hear your stories.

I paid harbor bay 10K two weeks ago and I havent heard from them since. I received a certified letter in the mail saying that my house was having a lien placed on it because they didn't pay the concrete company. I have a huge concreted hole in my backyard and no pool. I have called hundreds of times and the office is completely shut down. I am filing complaints on Monday and finding an attorney to get my money back. I don't have money or knowledge to complete on my onw

I am all so out 4,000 and know a lady out 3,000. I filed a complant with the city today. We need to all get together and put a stop to this before more people lose money. We need to get I contact some how. The lady told me he was selling off some of his truck today and I saw a notice on his door saying he owed the landlard 3 months rent Should we go to the police. Please post back ASAP thanks

Thank you for sharing. I just filed another complaint with the Attorney General's office and have filed police report with the Martin County Sherrif. I just alerted channel 5 investigators and shared this blog with them. Hopefully, someone can do something soon.

Hi Jaime. I saw the news report last night. I contacted channel 5 news but they have not gotten back to me yet. I am in the process of speaking with an attorney. I lost 22,800.00. But the most important thing is that his actions were criminal. Everytime he signed a contract and took money, he knew he was not paying his bills and he was in trouble. That is fraud and theft. I filed a police report in Martin County. His license is revoked in this county. I also have a lien against my house now. Can you e mail me a copy of the letter that Kevin sent to you. I called him and Derek out on all of this back in April and they refuse to speak with me. Kevin also called my home on 5/9, drunk and ranted and cursed at me. I'm in the same boat with all of you! I don't know what to do at this point...they started the work in March and it's not even half way complete. My calls also won't be returned. I did receive the email from Kevin but his voice mail is full and I can't get a hold of him. I have invested over $20,000 so far and I'm sure lost most of it.

The best thing to do is to file a complaint with your county licensing board and with the state licensing board and atty general as we all did.

I am being informed that at this time it remains a civil issue. Has any one hired an attorney? Is anyone interested in filing a class action suit?

You should also try to file a police report.

I think a class action suit is best if everyone wants to go after them. I've filed a complaint with the Department of Business and Professional Regulation and suggest that everyone else do that as well. I've also sent a certified letter to the business and his home notifying he has 30 days (at the advice of another pool company) to commence work otherwise we're going to hire someone else to complete and will sue for the difference. The quotes I am getting to complete our pool is a lot more than what we owe. In addition, I've also found out that they have completely screwed up the inspections for the pool and now I have to deal with that as well. The situation is going from bad to worse and I'm completely disgusted.

I hear you on that one. I lost 24,000 if you include the lien on my house for 1875.00 and it is costing me 45,000.00 to complete my pool. My original contract was 46,000.00 Therefore, my pool and deck has now cost me 69,000.00 and I am in debt to my retirement account and cannot retire now for at least 5 years. I had planned to retire next year so I could enjoy my pool. That will not happen now.

I am out $40,000 and $20,000 in damage to my yard. They started my pool first week of February and my yard has looked like a war zone since. I hired an attorney a few months ago and filed a lawsuit. I am very much interested in banding together to file a class action suit. I believe that what Kevin did is criminal. I heard that there are 14 of us and, with that number, there should be a penalty. I have the same story... Tons of unanswered phone calls and a mailbox that is full. I will call my attorney tomorrow and see if we can band together on this

Sandy-I'd be very interested in the class action. Any idea about lawyer fees? Unfortunately, that will be the deciding factor. I just don't understand how he got away with this for so long.:(

I am also very interested in a class action suit but not just against Harbor Bay Pools. The Better Business Bureau gave Harbor Bay an A+ rating without even checking them out. They had complaints before mine and unfortunately they always side with the business owner. Also the licensing boards of Martin County and St Lucie County as well as the state. They fell down on the job. Harbor Bay, Kevin and Derek have been in court too many times to count in 2010 and 2011 and no red flags were raised. Had they been looked at back then, none of us would be in this position because they would not have been licensed to work.

Hi. Anything new? Have not had a response to Terri Parker and I referred another homeowner to her. Sandra Rego hired an atty and is inquiring about creating a class action suit.

I am in the same mess! I paid a $3000.00 deposit & nothing has been done. I have a complaint with PSL building dept. & I also filed a police report. Hav'nt heard from either one.
