Hire some police to patrol our schools it's gonna get worse! Kids are gonna be untouchable, and teachers will be too scared to take care of anything. "Jimmy honey you should probably stop stabbing Bobby thats not very nice!" It's child abuse until it's your kid is being beat on by an out of control student and no teacher steps in. Call the police they will be there in an hour or so!

If you have never worked in a school u have no clue I have witnessed staff getting hit , spit on, kicked, cursed at, punched, smacked, tripped and is that not a form of bullying from the kids and heaven forbid that any parent would stand up for any child acting this way. If it was my child doing this you better believe they would get their bottoms warmed up when they got home. Staff has seen this behavior when children were young and worried about their behavior and down the line the students were in jail and even prison, these problem kids need to be kept in line, my words to Mr Moffitts when he came to new haven elementary was quote"I sure hope you have a back none because none of these other principals have had one, at mason or Newhaven elementary", and he done a wonderful job. You people should wake up what if this system didn't have any back bone!!! Mr moffitt I will continue to support you keep your head up you have more supporters than you know. And shame on the judge, but that decision was probably because she didnt wast the pig on her back!!!!

Am I missing the threatening behavior....cause i didn't see it... I saw a little boy who was upset cause he was being taken off the bus because he was a VICTIM of bullying...an he through a tantram an refused to go.... No where did I see him putting anyone at harm...an yeah the bus driver " the one sitting in the drivers seat" was smiling... but I also heard her plainly state it wasn't that boy it was the other one... You people a dislusional... Stick to this situation... I'm thinking this principle had a personal issue, an he used this little boy as a "stress reliver".. No matter how bad this childs behavior was, there is no excuse for this to have happened... My nephew is scared to go to this school next year... My guess is alot of kids were tramatized due to this.....SAD

Watched the 6pm news. I was really shocked to see those in support of Mr. Moffett. I have lost all respect. Why didn't you supporters in the hallway make eye contact with the camera? Were you embarassed to say you were supporting him? This whole situation sickens me.

Get off this man's c*ck and quit the damn complaining. He crossed the line and needs help. I love how he was smiling when he showed up but didn't seem to be smiling when the judge gave her ruling. This had nothing to do with back bone. This is about a punk who let his temper get the best of him. I hope he's worried tonight. I see your a fan of child abuse like i said before I'm so glad my kids don't go to NHES. This school system is a joke and so is boe. That punk will get what's coming to him in and out of court. I noticed his biggest fan Ms. Dickens wasn't there...interesting. I'm glad the state had enough burden to move forward, this man needs to own up to his actions. The WVDE has adopted written procedures for responding to or investigating complaints and widely disseminates these procedures to parents and other interested individuals including parent training and information centers, protection and advocacy agencies, independent living centers, and other appropriate entities in the state.
Within sixty days after the complaint is filed, the WVDE must:
1. Carry out an independent on-site investigation if the WVDE determines the state complaint is sufficient. The WVDE will conduct an on-site investigation, if determined necessary based upon the nature of the allegations, review of information submitted by the parent/adult student and the district and information obtained through telephone interviews;
2. Give the complainant the opportunity to submit additional information, either orally or in writing, about the allegations in the complaint;
3. Provide the district with the opportunity to respond to the complaint, including at a minimum, a proposal to resolve the complaint; and an opportunity for the district and the parent/adult student to voluntarily engage in mediation and/or early resolution;
4. Review all relevant information and make an independent determination as to whether the public agency is violating state or federal special education laws or regulations;
5. Issue a written decision to the district and the parent/adult student that addresses each allegation in the complaint and contains:
a. Findings of facts and conclusions;
b. The reasons for the WVDE’s final decision; and
c. Procedures for effective implementation of the WVDE’s final decisions, if needed, including:
i. Technical assistance activities;
ii. Negotiations; and
iii. Corrective actions, including timelines, to achieve compliance. Timelines for
completion of corrective activities will only be extended, if requested by the district within five days of the district’s receipt of the decision, based upon exceptional circumstances.
6. Address the district’s failure to provide appropriate services, including corrective activities to effectively address the needs of the student, and appropriate future provision of services for all students with disabilities; and
7. Permit an extension of the sixty-day time limit only if exceptional circumstances exist with respect to a particular complaint or if the parent and the district involved agree to extend the time to conduct the resolution activities (e.g., early resolution, mediation).
C. State Complaints and Due Process Complaints
If a written state complaint is received that is also the subject of a due process complaint, or contains multiple issues of which one or more are part of the due process complaint, the WVDE shall set aside any part of the state complaint that is being addressed in the due process complaint until the conclusion of the hearing. Any issue that is not a part of the due process action will be resolved following the established state complaint procedures and timelines. For issues that are addressed in the due process hearing, the hearing officer’s decision is binding on those issues and the WVDE must inform the complainant to that effect. Any remaining issues not addressed in the due process hearing decision will be investigated upon receipt of the hearing decision by the WVDE in accordance with the established state complaint procedures and timelines.
