These are good questions. Perhaps continuing discussion with an attorney is the next step. Although the name of one of the attorneys used is in the public record, I am loathe to post it on Topix. I will, however, provide that information thru e-mail on request.
I also understand that significant body of related documentation is available in digital format, such as documents from ALL FOIA requests, audio from council meetings & private meetings, copies of petitions, etc. Perhaps this could be requested as well.
The opinion of the attorney regarding initiative is relevant, but I think a second path could be available. The city council was unresponsive to petitioners and voters. The question is, are voters sufficiently dissatisfied to remove the offending council members? Arkansas law allows for recall of mayor and municipal "board of directors"... does this mean council members? In any event, they may want to run for office again. Would it be easier to defeat the current council at the polls, then modify the ordinance?
in any event, I would suggest the problem is in council leadership and responsiveness, and not with an ambulance franchise per se. For further discussion, e-mail [email protected]
Thank you.
Going to the Polls and ending terms of City Council is solution. Then participate in everything important to you and make meetings and dont let them regulate and tax everything. New Mayor, New City Council, New Attorney and better things for the City and (the population) whom support all of the above with a salary,Bonus's, retirment, health insurance and phone service plus fuel cards, coffee, water. Think the People have a steak in matters of public concern??? Not under this outfit. VOTE THE BUMS OUT! TEA!

<quoted text>OUR present city council, minus one, by their actions, has clearly proven that they have no shame and will disregard the voters. may be time for some recalls.
how many signatures does a recall take vs initiative?
if gathering signatures, do BOTH an initiative AND a few recalls.
put and keep some real pressure on em to straighten up and fly right. i don't see how they can hold their heads up and look folks in the eyes. the fire is lit, just need to hold their feet to it.
if promed ever threatens or sues the city for a voter withdrawn franchise, there name will be dirt in arkansas. pr nightmare for them.
where was the press coverage on the referendum and council over-ride. sun and kait coverage on the successful voter action was weak and sad. call em out on it.
Promed has every right to sue them duma**and I hope they do if they ever have to leave and it's not goin to due sh** to them they had to purchase all that new equipment and new trucks to be here they have every right and I encourage them to. If they do have to leave they didn't knw all of this when they came up here they put a bid in win the bid and put the base in its not their fault at all ur the one it's gna be a pure nightmare for because y'all might have y'alls supporters but there is also a lot of promed supporters so we r gna fight for it just as much as y'all will period

thought you said you were done posting here on this subject, so few will believe anything you post.

how did that last election work out for pro med supporters?

city has pro med locked in again and someone could come run the county and cost em dearly. how long they gonna stay fully staffed up with half the expected runs. they should beware of the council and bs they pull. had plenty of warning before submitting the last bid.

judge might look at the city contract different than you. folks legally had the right to make the franchise null and void.
if not enough profit, promed will find a way to give warning and leave, or work on city to redo it.

pretty active when they get up a referendum and pass it. don't see that very often.

also don't see councils piss on the voters very often. they will suffer for their actions eventually.

watch how the pool tax vote goes down and some are defeated next election.

and the elected council needs to show some respect for the voters instead of pushing their personal agenda.

"You certainly live up to your name...
Kibler never spoke as you claimed, this is another lie, part of the propaganda machine run by the city council.. There exists an audio recording where Kibler tried to demonstrate to local citizens that 3 full time ambulances were not economically sustainable in Pocahontas.
Your council members are in possession of that recording, why don't you submit FOIA and ask for a copy yourself? Or are you afraid to discover the truth?
Your characterization of MedicOne attitude is erroneous, you should not attempt to mislead the ppublic in such a manner. Keep in mind that the council actually realized the truth...they claimed there would be three ambulances with the franchise, but there are not three there are only about two and a half. ProMed would not be able to run three ambulances either, they would go broke. Now should we believe that ProMed will NEVER give us three ambulances? No, it's all about splitting hairs and trying to make political hay. If the city council stated reason for a franchise was legitimate, we would have three full time ambulances now. End of story."

Clearly you know nothing about ems because if they run in the county first of all it will still be on rotation so unless every single one is a medic one request they won't get every single run second the county is not where the money is the money is the hospital transfers and nursing homes so not to mention not every body has insurance so 1/4 of all ems runs are not even paying runs so no it would not financialy hurt them very much
medic one county requests and "not for hire" city runs would put the hurt on pro med/current franchise agreement.

Why do you even mention three full time ambulances? That was never asked for in the franchise. I think you are just trying to confuse the issue. Three full time ambulances were never part of the franchise and they never claimed that three full time ambulances would be provided under a franchise. You obviously don't know much about this issue. Where is your proof that the council ever claimed this? That was never in the paper or in the minutes of the meetings. You are just full of shit and trying to mislead people with your lies. The city's stated reason for a franchise was to provide increased ambulance coverage for the citizens which is accomplished with the day truck covering the city during the busiest hours. End of story.

What are not for hire runs? I thought the cities franchise prevented anyone else from operating an ambulance inside the city? Thanks for any info!

Seems like a membership dues only service would qualify as not for hire.
Anyone know if pro med receives or has applied for state trauma funds?
