Ahhhhhhh, but can the City LEGALLY do what they tried to pull on the citizens of Pocahontas? Attorney Dustin McDaniel needs to be consulted on this---not Mr. Grider.

As much as I hate to admit it, the city appears to be within it's legal rights to create an exclusive franchise. However, there are some options available to Pocahontas registered voters who are in opposition to the franchise.

Wow. I sure hope they have an ambulance available if you ever need them because, if you don't, you're screwed until they decide to show up. If they get away with this, that's what will happen. They stranded 3 patients in the ER the other night that needed transfered.

Ha stranded 3 people in the ER?? Please.. First in they are in the ER they are not stranded, 2nd a hospital has to accept a patient and until that done no one can go anywhere, 3rd if this was a real hospital they wouldn't be sending everything to Jonesboro because they don't want to treat them, 4th the ambulance service is not a freaking Tracie because you don't have the gas to go to Jonesboro your self so when you get to the ER your request an ambulance to take you somewhere else! I wish half you people knew even a fraction of the crap you think you know!!!

Sally, please let me help you try to understand the situation. Think about WHO told you "the county group people is trying to cause big trouble"? Do you think the county people should be excluded from the ambulance discussiion? Really? Have you realized yet that your source of information is not reliable? Have you not figured out that sometimes "parking at the county line" is part of a regional plan for affordable high qualty EMS coverage? You tried to frighten the voters, but that did not work. And, the city council thinks voters were confused and didn't know what they were doing when they voted NO to the franchise. I'll tell you what, you better give those voters credit for some intelligence. I think the voters knew EXACTLY what they were doing. They simply DO NOT WANT THE AMBULANCE FRANCHISE, AND THE VOTE PROVED THAT. Now, lets watch as the council tries to figure out a way to circumvent the will of the voters. Let me assure you, that's exactly what will happen.

will claim it can't be voted by referendum from the people, again, as it is an administrative ordinance.

bluffing will get some lawyers and $$$ involved.

should repeal their franchise since it is being violated and hand off to a qualified county committee.

Are you kidding? Understand the law? He admitted he screwed up writting the ordinance. Why does the city council,+2 (mayor and grider)think that they can rebid the franchise when the people just voted against a franchise 3 weeks ago. The only support I've seen for the ordinance (other than the ProMed owners)is the city council putting a letter in the paper.

When did he admit that? The paper said he screwed up by ever approving the repeal ordinance. The franchise almost got approved so obviously a lot of people support it as well. And they can rebid it because it wasn't the franchise ordinance that was repealed, it was the the one awarding it.

That's interesting. Certain actions of the council could be considered as "questionable" according to Arkansas statute, but nothing substantial can be proven. In many instances, the burden of proof is on the accuser. So it's business as usual, and the legislative phrase of the day is, "We can get around that".

Would you please share details of how you believe Federal law has been violated? Perhaps a reference to a specific statute?

Consider this...
Mr. Grider may not have completely described the details of his "error". His concept is that the franchise award ordinance was an "administrative" action, and not subject to referendum. But, the award ordinance was not defined as an "administrative" action, he crafted instead only a simple ordinance. Is this his error that left the door open?
Secondly, did he have any legal authority to do anything other than process the referendum? Probably he should have taken it befoere a judge, if he thought it wasn't proper. Why didn't he do that? Note that some casino issues were on the ballot, but the votes didn't count, because those issues were not correctly done.
The point is that the city council has always maintained that the franchise opposition was nothing more than friends and family of MedicOne...now that group is proven to be a MAJORITY of voters. The council answer to that is that voters were confused...really? Apparently they think that voters are stupid? The council refuses to take no for an answer, and now will try to bully the voters into submission.
So, the NO franchise group has an uphill battle. This thing could continue until the next election, or perhaps even a special election.

citing some obscure past zoning case law ruling is likely a weak threat and bluff.

I heard he admitted that was his mistake at the city council meeting. I would like to see the minutes on the meeting, that would be interesting to publish in the paper. Good luck with that happening though.
