It depends on the intent of the students. Obviously they knew he was gay. What other reason could they have for posting that video online other than to harass him or attempt to humiliate him.

Maybe if there are a few prosecutions of cases like these, the morons out there will think before they harass.

Violation of Civil Rights by illegal taping of persons in private without their consent.
Gay or hetero, that is actionable.

This is a horrible story but the original report from Fox mentioned that a priest spent an hour consoling this young man's parents. Perhaps what the priest represents is the real criminal, not the two young people perpretrating what they thought was a simple prank. After all, who nowadays, especially in the New York metro area, would kill themselves just for fear of being outed in college unless they were realy f**ked up by organized religion?

Agreed, but the question is does it rise to the level of a bias crime? I think it's pretty obvious, but it's going to be difficult to prove in a court of law.

Get them for what you can.

You could also slap them for trafficking in pornography, though that might be hard since no money changed hands between the posters and viewers (I assume).
