For the last 3 months Family Video has refused to answer at least four complaints made to the Illinois Department of Labor in regards to their wanton and willful disregard for Illinois ODRISA law, which states that any Illinois employee working 7.5 hours or more is due a 20 minute paid meal period. Family Video does not allow any breaks unlike Hollywood Video and Blockbuster.

Family Video's management has purposefully misled their employees and refuse to cooperate with The Illinois Dept of Labor.

I ask that everyone boycott Family Video and all of its locations until this matter and the ensuing court case gets settled.

If you have worked at Family Video anywhere in the USA, and feel that your legal rights were violated, then please post your story and contact info in this thread.

A class action lawsuit is past stage one already and getting ready for the next stage.

Family Video will answer to this one way or another.

Also, there is a protest happening at the West Chicago location on June 15th. Be there and help us all get back the rights we lost working there.

There is a Family Video located at Caton Farm Rd and Essington Rd in Joliet. Do they do the same thing? I've never rented from there and if they're mistreating their employees, I never will.

Thank you. An to answer JR's question. All Illinois locations are in violation. Remember reps from the IDOL told me they were in violation. And two lawyers told me they are in violation.

And although Fam Vid is located in many states, I can only say for sure that they're violating Illinois Law.

And it should also be noted that every Fam Vid location I've been to, does not have any of the ILLINOIS WORK POSTERS hung up in their stores. These posters inform employee's of their rights, and Fam Vid is the ONLY place I've ever worked in 17 years that didn't have this poster up.

Again, Blockbuster and Hollywood Video have this information hung up in their stores, as well as have lunch breaks in writing and automatically added to their schedules. Fam Vid does not.

I used to work 8-12 hour shifts without breaks.

If you feel strongly about this issue, as some of us do, then please contact Fam Vid at their website www.familyvideo.com
and contact them asking what their meal period policy is. If you get an answer, please let me know, I managed several stores and still never got a straight answer.

SPRINGFIELD - Family Video will pay a $225,000 fine and make sure its stores are accessible to the disabled under a consent decree announced Thursday by the state attorney general's office.
The decree filed in Cook County Circuit Court resolves a lawsuit filed by the state against Family Video in 2004. When the state sued the Springfield-based video store chain, Attorney General Lisa Madigan said complaints dated back to 1997. Every Family Video outlet in Illinois violated at least one provision of laws that are supposed to ensure stores are accessible to the disabled, she said then.

Alleged violations included sales counters that were too high for wheelchair users, entrances that were blocked by vending machines and narrow parking spaces that wouldn't allow a disabled person to easily enter and exit vehicles.

Under the consent decree, the chain will ensure its counters, building entrances and parking lots are accessible to the disabled, Madigan's office said.

Family Video, the nation's third-largest video chain, has more than 90 stores in Illinois, including two in Galesbrug

"It is unacceptable that Illinois residents with disabilities have been denied access to such a popular Illinois business," Madigan said in a written statement. "Today's consent decree will help to ensure equal access."

Family Video representatives could not be reached for comment Thursday. When the lawsuit was filed, an attorney for the company didn't deny that violations existed, but said most were relatively minor and were being addressed.

Madigan warned that her office will take action against other businesses found to have violated accessibility laws.

"Illinois business must comply with applicable state and federal laws regarding physical accessibility," Madigan said. "When we find that businesses have violated these important laws, we take action to bring them into compliance."

All Family Video stores nationwide have this same policy. There are no paid "breaks" ever. You are expected to munch at the counter in between customers and doing work no matter if your shift is 3 hours or 12 hours. Only time away is if running a deposit to the bank, which does not occur often enough for everyone to do this, and really may only be 3 minutes. And going to the bathroom. Any employee speaking negatively of the company, such as this, is subject to dismissal.

I worked there for nearly 4 years and was never allowed to have any breaks. Good luck munching at a counter the night before a holiday, because you are always too damn busy and nobody else would work. One Thanksgiving I worked a 13 hour shift without any other employee's coming in.

Yeah, so you got to eat at the counter and get paid for it. I'm not even going to get started on the racism and sexism that goes on with that place.

LOL! Junior , No work enviorment should be allowed to do this , It takes people with guts to be the bad guy to make a stance.Dominicks makes their young 16 year olds here in Oswego work 37 hours during the school year, parents have gone in and made statements , There are many Illinois laws that alot of companies do not follow especially with minors . working certain hours , not past certain times , breaks etc. sometimes my child did not get breaks , Alot of parents made their kids quit . What ever the issues are they need to be fined accordingly. These rules were set fourth for the people by the people to protect human rights . So You Go For It, I hope It works.......

There was a two day protest at West Chicago Fam Vid in regards to their selling pornography in their store.

When I worked there, there were at least five incidences of children making their way into the adult room, which Fam Vid refuses to properly keep away from Children.

And don't get me started on the incident involving the customer who was JERKING OFF in the adult room.

The protest continues this weekend at the West Chicago location.

The protesters were out on Friday evening with signs everywhere demanding that Family Video stop selling pornography. I went over and started to educate the protesters about the violations of Workers Rights that Fam Vid is being sued for.
And so it looks like many people are angry at Fam Vid.
Keep our children safe from PORN and make sure our workers get the rights the country and the state affords them.
Family Video is profitting off of porno and illegal labor practices.
Please call them (phone number on website) to speak your mind and let them know you'll never shop their stores because of these issues.
It took them over ten years and $225,000 in fines just to become handicapped compliant. AND THEY STILL WON'T HIRE handicapped people.
I had to turn someone away becuase he had a learning disability and my boss told me he couldn't work there because of it.

I too caught a guy masturbating in the adult section. I also had guys walk out with hard-ons. One thing that always bothered me was the audits. I was always taken to the adult room for my questioning, which never bothered me. What did was the fact that because I was so comfortable being there, it got me marked down. I actually "had a talking to" because I joked back about an adult movie the aduitor was joking about.

I used to work for a video store in Joliet called Video Basics on South Richards St. We had some strange people come in there and spend quite a long time in the adult section, then they'd leave without renting anything. We actually had a camera monitoring that section of the store but I never witnessed any lewd acts, but heard about them. When the store first opened a customer rented about 60 adult movies that were due back in three days. I don't know what he did with them and I don't want to know. I often washed my hands after a customer returned an adult movie to me. The amazing thing is that the adult section and the Blacksploitation movies earned more than 1/2 the stores rental income. The manager showed me the report.

We used to have manager meetings in the Adult Room. Every month we'd get together for four hours in the porn room and discuss Fam Vid issues. I don't get it. That place violated so many basic rights.

And if they paid their managers a decent salary, believe me, the rentals would be $5. The discount is paid for by the Managers.

They used me. They lied to me. They violated my rights and the rights of my co-workers.

Steps have been taken, and thats that.

I'm one of those people out boycotting in West Chicago every Friday night from 5:00-8:00. We're going to do it all summer, and the mayor is looking into ways to make it harder for people to get in that back room (IDing people under 21, lock on door, etc.) It galls me that they call themselves “Familiy” video and rent porn, which is harmful to families (indeed, all people). I wasn't surprised to read the posts about people self-pleasuring in there, but I was surprised they held employee meetings in those rooms. I think that would qualify for sexual harrassment and they are breaking the law to expose employees to that stuff in a required meeting. If any of you are still working there, think about bringing a lawsuit against them for sexual harrassment (doesn't matter if you're male or female).

I have been spreading the word about the West Chicago Boycott. I understand you are protecting West Chicago, but if people would go to their stores all over the area, imagine the response.

Would Family Video be the 3rd largest chain if they didn't sell/rent porn. Blockbuster and Hollywood are #1 and 2 but they don't rent porn.

And to put the bathrooms near the adult room is just making it easier for gross conduct, underage kids sneaking into the room, and making it easier to steal.

I always loved it when I was given a Jenna Jameson flick on top of a Free Kids Rental. There were plenty of customers who would rent porn while they had their children in the store with them.

Once I had a Spanish speaking family that came in and argued about a late fee. Problem was the late fee's were for adult movies, and they didn't speak English, so they had their 9 year old daughter argue with me about an adult title.

I immediately told the girl I was not comfortable with the conversation and the late fee would be removed. The parents didn't care that the daughter would be translating an argument involving a porn.

I frequently saw that. Apparently, the parents were "watching" their video while the kids were watching theirs in another room.
This may seem like one of those Urban Legends, but it actually did happen. For this to make sense, you have to understand that the store I worked at, Video Basics, all the movies were in brown boxes you couldn't see through and a number label was on the tape and the box. When customers returned movies we had to check all the boxes to make sure the tapes were in the correct boxes. Many times I'd have to switch tapes between multiple boxes. When renting an adult title to someone I found a Flintstones cartoon in the box. Obviously, another employee didn't verify the tapes were in the right boxes when they were returned. I went to the box the Flinstone movie was supposed to be in and it was rented out. My guess is that someone rented the children's movie and got the Adult title, instead. I never did find out what really happened, but I can picture little Junior going to his bedroom to watch the Flintstones cartoon and getting an education his parents didn't intend. After that incident the manager insisted we use clear boxes and put the number labels on the tapes.
On another note, a Spanish speaking family that were regular customers would frequently rent up to 7 videos. When they would return them they'd drop the boxes on the counter and bolt out the door. All 7 tapes were always in the wrong boxes and it took quite a while to straighten them out. One time I made the customer wait until I sorted through the tapes and boxes to check them in and I took my time doing it. I never received tapes in the wrong boxes from those customers again.

It's amazing that people will complain and file lawsuits regarding a job instead of quitting right away. Let's face it, Family Video is not a long term career move for anyone other than Radio Shack rejects. The best way to handle this is to do what you are doing here, spread the word. The marketplace, including employment, will tune up Family Video. Ultimately, the only people who will work there will be illegals. That will destroy their business because it will infuriate people like me. As far as the adult section, it is a major income producer. When I managed an independent video store it was 40% of the revenue but took up only 15% of our floor space. Blockbuster and Hollywood are mega corporations with huge backing so they not only don't need the adult videos, they get away with censored versions of releases and the sheep will continue to rent from them regardless. Video stores will be obsolete in 5 or 10 years anyway. Direct downloads on your home satellite or cable will see to that.
