Doesn't this mean the City of Pittsfield was plainly at fault for trying to prevent Spectrum Healthcare Systems from opening a downtown clinic?
Note that Pittsfield taxpayers are once again being forced to pay through the nose for a stupid decision made by a Pittsfield mayor.

PITTSFIELD -- Pittsfield taxpayers will foot the $100,000 bill incurred by the city as part of a settlement with Spectrum Healthcare Systems that was filed in federal court on Tuesday to resolve a dispute over a proposed methadone clinic.

According to Mayor Daniel L. Bianchi, the payment is coming from funds in the fiscal 2013 budget approved by the City Council in June.

"We set aside the money in case we needed it," Bianchi said. "I was hoping we wouldnít use it."

City Solicitor Kathleen E. Degnan noted the cityís liability insurance wonít cover a claim in order to pay the penalty.

Through emails to The Eagle and before City Council, several city residents on Tuesday said they were thrilled with the settlement.

"I think this is a very expensive lesson to pay $100,000 to satisfy a lawsuit that should have never taken place," said Mary Lou Robinson.

The settlement also allows Spectrum to open its methadone treatment center on Summer Street this fall, but it will consider eventually moving the center into a Berkshire Health Systems facility, city officials announced Monday.

The Worcester-based nonprofit sued Pittsfield last year after Mayor James M. Ruberto and his administration sought to block a building permit for the clinic.

"We commend the city for reaching a negotiated resolution of this matter," said Charles Faris, Spectrumís president and CEO.

However, Faris, in his brief written statement issued Tuesday, didnít comment on the specifics of the settlement, opting to look forward to the clinicís opening later this fall.

"We are primarily concerned with getting the treatment service operational and responding to the significant levels of addiction in Pittsfield," Faris said. "We concur with Mayor Bianchi that the provision of this service is part of the solution, not the problem."

The state Department of Public Health has determined Pittsfield needs a methadone clinic to serve the number of drug addicts who reside here. According to state health officials, there were 695 non-fatal opiod related overdoses in Pittsfield three years ago.

Meanwhile, Berkshire Health Systems officials on Tuesday had no further comment on the possibility that BHS could provide space for the clinic if Spectrum chose to relocate.

Pending approval from the cityís Building Department -- likely by mid- to late October -- the clinic will open in the Berkshire Nautilus building, according to city officials. The second floor of the three-story building is currently being renovated to accommodate the clinic.

According to Spectrumís website, it has posted job openings for eight employees who will staff the outpatient facility.

The potential location of the methadone clinic created a firestorm of opposition two months ago when word spread that Spectrum was possibly looking at private property on Stoddard Avenue. Many residents and city councilors were upset over that location, primarily because the city had made no mention Spectrum was considering the site.

Bianchi said he couldnít comment on the negotiations between the city and Spec trum, because he had to honor a confidentiality agreement between the nonprofit and Ruberto, reached prior to the mayor taking office Jan. 1. <<<<<

I'd like to know if Ruberto consulted with whomever was representing the city on legal matters when he attempted to block Spectrum's plan to open a methadone clinic in Pittsfield. Or did Ruberto come up with this arrogant boneheaded irrational dysfunction decision all on his own?

There's so much to thank Ruberto for during his eight long, long, long years in office. There was the time he repeatedly interrupted a speaker during the public open microphone section of a council meeting who was questioning why the taxpayers should have to foot the bill for the demolition of a building on east st.. And that MLK street name thing he tried to ram down the throats of the citizens. And the baseball tickets thing. And the alleged water dept. fraud. And the multiple jobs for his friend John Barrett. And, well, who knows whether or not the whole story of SteroidsGate was actually revealed. Whether or not there was a cover-up in the police dept. And that costly mosquito eradication program. And all those tax increases. And just what Ruberto knew about his good friend Angelo Stracuzzi's criminal immoral appetite for young boys and when he knew it. And Ruberto bypassing the city council and appointing council***** Yon's ugly husband Greg Yon to director of maintenance and the lovely TFB to the position of director of administration. And who could forget the perks for a special car dealer.

And wasn't Bianchi the guy who it was hoped would reopen the GE Consent Decree?

With Dan I think a better course would be to lower your expectations of him. I think if you lower your hopeful expectations to a more reasonable level to expect nothing of him you won't be disappointed.

I believe that all of the anti-Dan Bianchi talk in Pittsfield politics is due to the Good Old Boy network's propaganda. Mayor Dan Bianchi is doing the best he can do with what he has. If someone handed you rotten lemons, would they expect you to make lemonade?

Correct me if I'm wrong, but doesn't Hizzoner the Mayor have prime authority over the police department as well as sayso over who serves as police chief?
As such, Bianchi could, if he wanted, expose exactly what transpired during Steroidsgate, and publicly lobby for random drug testing of all city employees.
But so far not a peep from this guy.

Generally the taxpayers are happy to have gotten off with only 100 grand. Under the Ruberto administration it would have been much higher what with the kickbacks and all.

The good news is the "acting" chief has so far not risen above the title of "acting" chief and if on the slim to none chance that the dirty **** in that ****hole ever hits the fan the "acting" chief should be the first to be covered in it.

the building for over a year.
the clinic should of opened quietly a year ago
hmmm......
a year and $100,000.00 later it will open
right where the signs have been!

I have to admit I didn't enjoy one second of the eight long, long, long, sickening years of Ruberto's reign. There's dirtier **** going on in Pittsfield than a methadone clinic moving on Summer St. Bianchi should Ruberto send a letter demanding $100,000 to cover the cost of his arrogant behavior and lack of respect for taxpayer money.

You would have had to explain "interest of taxpayers" to Ruberto. I seriously doubt he even ever took that into consideration in the eight years he was running Pittsfield into the ground.

and another issue. How is ever a good idea to spend more than $300,000, more than $300,000, to rehab a blighted property and then turn around and attempt to unload it, dump it, for less than $80,000? Who's grand idea was this? Who rehabbed this property? How much money was made off this rehabbed property?
