It has nothing to do with what the server get's as a tip. It is based on sales. You could make $20 in tips one day, but after all the sales of the day they calculate 3% of your sales and require you to pay that back to them. Even if you didn't make enough money to cover it. I have seen girls literally walk out the door with $10 after having been forced to tip out $20. And trust me they don't care if you have a child to feed at the house and need gas to get to that child. They will make you pay that. Well I shouldn't say make you pay it, but if you don't they threaten consequences.
And just to get it straight. The servers there do not care one bit to tip out bartenders who make them drinks all night...if they make them drinks. But to tip out a host we find crazy. The company should pay them their wages not the tips that are left for the servers. Basically it is up to the servers to make up at least $5 an hour for every employee up from. CRAZINESS. Oh yeah and lets not forget that the bartenders make tips too, but yet they do not have to participate in the tip share, they just get to collect in the tip share. And there are many nights when the bartenders work the bar and work a section too.
We realize that no place is perfect and almost all of us had high hopes for that place. They promised the world to us thats for sure. But for many of us the first we heard of the tip share was when we were signing the paper many months after we were hired.
I work as a server and they do the samething to us. Its not fair I work hard for the tips I make! I had it happen to me that the bartender wouldn't make my drinks because she was told I didn't tip out enough at the end of the night! When I went to the manager about her not making my drinks I'm not sure what was said to her but he was the one that ended up making my drinks! The sad thing is that IF the bar does make me drinks I always tip out to them but I don't feel I should give 3% of sales to them when just like you stated they don't have to do the same with there tips! OUTRAGED over this! Same as where I work it should be kept only in the office about what you do tip out but our key LOVES DRAMA and shares it with everyone about what you tipped out! Me and several servers were cut early because we where very slow and one server only had one table and made 2 dollars off that table and the key made her give up half her tip so she walked out with a buck for 2 hours of being there! This shit needs to STOP! And us severs need to be able to keep what we make and tip out ONLY if we want to! Lexington Server Worker!

why is there such a double standard at texas roadhouse. i see good employees fired for small infractions while other employees can get selling drugs at work get fired but get their job right back cause they suck up to the managing partner diedra. if you are one of her chosen ones you can get away with murder. so next time you eat there and need some dope just ask your server they will sell it to you. not too bad a great steak and some dope what a dining experance

I think its awful that the busboy's get 2:13 an hr. and suppose to receive 1 $ an hr off each server, the servers clock out all the time an run out the back door, while the sa's r cleaning the tables.

This is what I would do, go talk to a lawyer. It sounds like what is happening is illegal and you should sue them. Whatever you do don't quit your job even after you retain an att. This is a clasic case of abuse of power among others crimes. If I were in your place I most certainly contact an att. ASAP!

To the Way it is -- the labor relations board (or the National Labor Relations Board -- NLRB) usually does not investigate wage and hour disputes unless the issue is associated with collective bargaining activity (unions). There is no such thing as "Federal Mininum Wages board" --I believe you mean the Department of Labor which administers federal wage and hour issues under the FLSA (Fair Labor Standards Act). Go ahead and try, but if you are not an employee at the store, I doubt you would have much luck. It has to be someone affected by the policy or law, which both in Kentucky and under the FLSA are both described as an "employee."
Rabbit12,you are right about everything you said on here..Sounds to me like you studied Law..And you are right about the NLRB..

I have NO IDEA how Deedra got a managing partner position. She is AWFUL. She will tell you straight to your face that if she doesn't like you, you won't get a good schedule/section/etc. not to mention she spends more time on vacation than any other human being I've ever met. She's rude and she treats people like garbage. And her husband just follows her around like a little lost puppy. She is by far the worst manager I have ever had.

I couldn't agree with you more!!! I was never late for work, never called in, never messed up on any orders, but was still fired for a bogus reason!! I was told that I was on drugs and could no longer represent them anymore which was a bunch of bs!! I asked Deedra to give me a drug test and she refused she knew I wasn't she just did not like me along with Dorrinda! Deedra had absolutely no reasoning for firing me, but still yet two employees after that happened to me were caught dealing drugs yes they were fired but they hired them both right back. There are so many employees that work there that are on drugs that it is ridiculous and the deals are done right under their noses. I guess you have to be a brown-noser to keep your job there, and that's one thing I wont do. I will work my ass off for you, but I will not kiss your ass to keep my job!!!

If I had been fired for the reason of suspecting of using drugs, I would have insisted on a drug test, and if they didnt give me one, I would have gone to my family doctor and asked for one, and taken the results, if 100 percent negative, to the head of the company.
If I were drug free, I would then sue them for wrongful termination of employment.
There are civil rights for people, you have to know the right people to talk to.
This manager has a boss as well, and this company has higher ups outside of Pikeville.

I have had a lot of people tell me the same thing about sueing them, this was not the only incident that they did to me. The service manager had another server come to me in the dining area and insisted that I had stole a coworkers cell phone all bc my pack of cigs in my apron pocket looked like a cell phone so I dumped my apron out onto one of the tables and pulled out all of my pockets while the service manager stood at the bar and watched. This woman harrassed me constantly out there but I just figured there was nothing I could do bc it would be my word against all of theirs. I practically begged for them to give me a drug test, her exact words were " We will not be doing that... sorry." I didnt know that if that was there reason they had to test me to back up their accussation, but they would prob. lie about the reason for firing me. That was the first and only job I have ever been fired from and I have worked since I was 18... Im almost 29 now. This happened back in March.... do you think there is a time limit on me acting on something like this???

Yes, sadly, if they told you point blank you were being fired due to suspected drug use, you would have needed to disprove it immediately, or within the time limit for drugs to leave the body, I would say probably within 30 days.
A hair follicle test would show drug use over a much longer period of time, I am not sure how long, its different Im sure for different drugs.
But, you should have insisted on a hearing with the higher ups for the manager who fired you to give reasons and allowed you to disput it.

You obviously dont know many servers. First of all to make a hundred dollars at 2.13/hour it would take 50 plus hours without any taxes and deductions. Second, servers typically dont get a check due to yhe 2.13 covering taxes, social security, etc. You are more than welcome to look at my check stubs for proof.

I find it very funny when a server claims that there paycheck is for 0.0 its just not true every server I have ever known would bring home atleast 100.00 every payday yes that is not much at all but when you add in the tips they do very good and they are only required to claim a little over $5 in tips a hour and most make double to three times that amount and in some cases when buisness is very slow and they do not make enough in tips to raise their pay upto minimum wage then the store has to pay them for the hours that they do not make min. wage so please dont feel sorry for the servers they do pretty good for themselves when it comes to bring home pay their paychecks are crap but they more than make up for it in take home tips from day to day I am a former server and I know how serving and tipping works the servers that want to complain need to find a diffrent place to work or just shut the hell up and to be honest anymore when i go to a resturant I dont tip the server I tip the cook all a server does is bring me my food the cook is the one who makes sure it is cooked right

well its simple,to this employee who is pissed off just quit or find another job, if you do not like the way things are run. No sense in ruining a good business and a good place for us to eat at. Find another job. I mean really its a pretty simple job what do you expect. That is how the food/resturant business is run. everywhere not just roadhouse

Tip out is voluntarily & it is not mandatory. First if you can't get your GM Deedra to corporate then you should contact corporate with what your seeing. It sounds like she a manager from hell who is a heartless bitch. Texas Roadhouse is suppose to be top 50 in the country to work for too. Scary! You need to document the amount you tipout on your checkout and do it everyday and go see an attorney! There are several here in Louisville that you can just google restaurant discrimination and although it may be hard to file a suit against discrimination they sure know how to file for back pay. Even better keep not tipping out and let your nasty GM fire you. Then it's for sure a law suit. Sounds like you could set the crazy bitch off pretty easily! It sounds like she will discriminate against you if you don't and then take action! There are too many places to wait tables to put up with bad management. Do something!!
