1. If what the foreman had timbered off the entire break;and done it correctly and up to code; why did the inspector tell him to build a crib.
2. If no violation existed and, no violation was going to be written, why did the young man do what the inspector told him to do.
If you are a tired OLD miner, you really should be more concerned for your soul than be calling people a "fool". You do that is a sin don't you.
I lost a family member in a mining accident. I know the tragedy of mining. He was in his early 30's. It was during a holiday and he was told to perform a procedure, by a money hungry operator, that was very dangerous. To keep his job he done it. It cost him his life. Had MSHA been inspecting that day, this death would have not occurred. So, you are preaching to the choir on this one. If it were not for Federal Regulations most of the operators who operate these little dog hole, water filled mines would have men killed daily. Most mines of these small holes are contract miners for larger companies and $$$$$$$$ are the only thing the operator is concerned about. MSHA would have fired this inspector if he had told this young man to build a crib for no reason. MSHA has obviously written you several violations. You obviously have tried to bribe the inspectors at one time and now things aren't working out so well for you. Give it up! Either mine coal according to law
or; get out of the coal business. You know the cost of mining when you got into it. You knew the regulations when you opened a mine.
If you are broke, so be it. You are not the first and you will not be the last. Quit blaming everyone else for your problems. Do it right and you will have no problems.

Tired is just typical of what I had to deal with in the over 25 years I worked for MSHA. He and his type are for the most part gone, partly as a result of fine people I worked with for many years. Yes we had a few bad apples, those were exposed and terminated. "Tired" could of and probably was one of the few that as a result of our dedication to miners safety found that he could no longer continue to operate. Now his heated uninformed exchanges only expose what a danger he surely was to the fine people he put in danger.
As to your pay offs. That admission clearly indicates a rouge mentality and approach to safety. If your operation was so wrongly made why wouldn't you use the proper channels to expose the violations? Why do you now after so many years choose to hurl unsupported accusations on a forum such as this? If your true desire is to help your fellow miner why don't you pick up the phone and call Richmond?
I suspect your name and reputation is well known by those folks. Seems you may be "Tired" as a result of foolish ranting not from providing a safe work place. In addition your claims to us putting people out of work, rest assured your men found good safe employement elsewere. Most likely saved some of all of future injuries or fatalities

I am not believing this. Some people never learn. I think you either didn't follow that guy's statements and his proof of your failings as we coal miners did,(and we loved it)or you're just a glutton for punishment. He won that already. We are not your friends. many times the boss has told us to not insult you. we kno you can put us out of work when you get mad. He was right about us counting pennies this Christmas as your families spent the big government check. I am without mony because of the cost of mines today. there is no job anywhere inamine.

Tired ol miner found this accurate report. It says it everything we have said. nothing was done right. MSHA is still not ashamed. Their inspectors come here and talk trash. idiots

This is more of an in depth investigation following the failed attempt of msha to rescue trapped miners at Crandall Canyon....Pay special attention to the last entry. Would you want msha attempting to rescue YOUR family member trapped underground?.....

• Persons who could have contributed significantly to the initial ground control
evaluations after the August 6th bounce were either not assigned to the rescue
effort or were delayed in their arrival
• The MSHA person-in-charge of the rescue operation was not clearly identified
• The MSHA person-in-charge of the rescue operation did not focus his attention
solely on the rescue effort, as much of his time was consumed by conducting
and/or attending family and media briefings
• MSHA failed to establish protocol for conducting regular formal briefings and
debriefings
• The person-in-charge created an environment that hindered open
communications with the rescue workers
• MSHA failed to ensure secure communications between the surface and
underground
• MSHA failed to obtain all information pertinent to the protective support system
used during the rescue operation
• MSHA improperly permitted media representatives and family members to
enter the rescue area, and allowed an unlimited number of persons underground
during the rescue operation
• MSHA failed to follow established mine rescue protocol at all times at the
Crandall Canyon Mine
• The limits of MSHA’s authority, responsibilities, and liabilities under the
provisions of § 103(k) or § 103(j) of the 1977 Mine Act have never been fully
defined
• MSHA failed to conduct a formal Risk versus Value analysis during the
underground rescue effort
• MSHA failed to maintain its mine emergency equipment up-to-date and in good
repair
• MSHA failed to comply with the provisions of the MINER Act by not acting as
the primary source of information to the families of the trapped miners
• MSHA failed to always provide clear and accurate information regarding the
mine accident to the families, and did not correct or contradict misleading or
incomplete information presented by the operator
• MSHA failed to comply with the provisions of the MINER Act by not acting as
the primary source of information to the media and the public
• MSHA failed to always provide clear and accurate information regarding the

• MSHA failed to provide adequate training in mine emergency procedures for
